(12565) Amir bin Sa’d bin Abi Waqqas (may Allah be pleased with him) narrated from his father that he said: The Messenger of Allah (peace and blessings of Allah be upon him) came to visit me in the year of Farewell Pilgrimage and I was in great distress. I said: “O Messenger of Allah! I have been afflicted with this disease as you can see and I am wealthy and my only heir is a daughter. Shall I bequeath two-thirds of my wealth?” He (peace and blessings of Allah be upon him) said: “No.” I said: “Half?” He (peace and blessings of Allah be upon him) said: “No.” I asked: “One-third?” He (peace and blessings of Allah be upon him) said: “One-third is also too much. It is better for you to leave your heirs wealthy than to leave them poor, begging people for help. And believe that whatever you spend for the sake of Allah's pleasure, you will be rewarded for it, even if it is a morsel of food that you put in your wife's mouth.” I said: “What if I am left behind by my companions?" He (peace and blessings of Allah be upon him) said: “If you are left behind and then you do any deed seeking the pleasure of Allah, your rank will be elevated, and there is hope that you will live longer and some people will benefit from you and some will be harmed.” O Allah! Grant success to the migration of my companions and do not turn them back on their heels. However, there is grief for Sa'd bin Khawla.” He (peace and blessings of Allah be upon him) felt grief because he had passed away in Mecca.

(١٢٥٦٥) عامر بن سعد بن ابی وقاص (رض) اپنے والد سے نقل فرماتے ہیں کہ انھوں نے کہا : رسول اللہ (صلی اللہ علیہ وآلہ وسلم) حجۃ الوداع کے سال میری عیادت کرنے آئے اور میں بہت زیادہ تکلیف میں تھا، میں نے کہا : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! مجھے بیماری آئی ہے جیسا کہ آپ (صلی اللہ علیہ وآلہ وسلم) دیکھ رہے ہیں اور میں مالدار ہوں اور میری وارث صرف ایک بیٹی ہے۔ کیا میں اپنے دو تہائی مال کی وصیت نہ کر دوں ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں میں نے کہا : نصف کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں۔ میں نے پوچھا : ثلث کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ثلث بھی زیادہ ہے۔ اگر تم اپنے وارثوں کو اپنے پیچھے مالدار چھوڑو تو اس سے بہتر ہے کہ انھیں محتاج چھوڑو اور وہ لوگوں کے سامنے ہاتھ پھیلاتے پھریں اور یقین کرو کہ تم جو کچھ بھی خرچ کرو گے اس سے مقصود سے اللہ کی خوشنودی ہوئی تو تمہیں اس پر ثواب ملے گا یہاں تک کہ اگر تم اپنی بیوی کے منہ میں لقمہ رکھو گے۔ میں نے کہا : اگر میں اپنے ساتھیوں سے پیچھے چھوڑ دیا جاؤں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اگر تم پیچھے چھوڑ دییجاؤ اور پھر کوئی عمل کرو جس سے اللہ تعالیٰ کی رضا مقصود ہو تو تمہارا مرتبہ بلند ہوگا اور امید ہے کہ تم ابھی زندہ رہو گے اور کچھ لوگ تم سے فائدہ اٹھائیں گے اور کچھ نقصان اٹھائیں گے۔ اے اللہ ! میرے صحابہ کی ہجرت کو کامیاب فرما اور انھیں الٹے پاؤں واپس نہ کر، البتہ افسوس سعد بن خولہپر ہے، آپ (صلی اللہ علیہ وآلہ وسلم) نے اس لیے افسوس کیا تھا کہ ان کا انتقال مکہ میں ہوا تھا۔
(12565) Aamir bin Sad bin Abi Waqas (Raz) apne wald se naqal farmate hain ki unhon ne kaha: Rasul Allah ((صلى الله عليه وآله وسلم)) Hajjat al-Wida ke saal meri aiadat karne aye aur main bahut zyada takleef mein tha, main ne kaha: Aye Allah ke Rasul ((صلى الله عليه وآله وسلم))! Mujhe bimari aayi hai jaisa ki aap ((صلى الله عليه وآله وسلم)) dekh rahe hain aur main maldar hun aur meri waris sirf ek beti hai. Kya main apne do tihaai maal ki wasiyat na kar dun? Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Nahin. Main ne kaha: Nisf ki? Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Nahin. Main ne pucha: Sulth ki? Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Sulth bhi zyada hai. Agar tum apne warison ko apne peeche maldar choro to is se behtar hai ki unhen mohtaj choro aur wo logon ke samne hath phailate phiren aur yaqeen karo ki tum jo kuchh bhi kharch karoge us se maqsud se Allah ki khushnudi hui to tumhen is par sawab milega yahan tak ki agar tum apni biwi ke munh mein luqma rakhoge. Main ne kaha: Agar main apne sathiyon se peeche chhor diya jaun. Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Agar tum peeche chhor diye jao aur phir koi amal karo jis se Allah Ta'ala ki raza maqsud ho to tumhara martaba buland hoga aur umeed hai ki tum abhi zinda rahoge aur kuchh log tum se faidah uthayenge aur kuchh nuqsan uthayenge. Aye Allah! Mere sahaba ki hijrat ko kamyab farma aur unhen ulte paon wapas na kar, albatta afsos Sad bin Khaula par hai, aap ((صلى الله عليه وآله وسلم)) ne is liye afsos kiya tha ki un ka inteqal Makkah mein hua tha.
Amir bin Sa'd narrated from his father that he said: "In the year of the conquest of Makkah, I became ill. The Prophet (peace and blessings of Allah be upon him) came to visit me. I said: 'O Messenger of Allah! I have a lot of wealth and I have only one daughter as my heir. Should I bequeath all my wealth?' He (peace and blessings of Allah be upon him) said: 'No.' I said: 'Half of it?' He (peace and blessings of Allah be upon him) said: 'No.' I said: 'One-third?' He (peace and blessings of Allah be upon him) said: 'One-third is alright, and even one-third is a lot. It is better for you to leave your heirs wealthy than to leave them poor, begging people for help. Indeed, you will be rewarded for all your spending, even if it is a morsel of food that you put in your wife's mouth.' I said: 'O Messenger of Allah! I fear that I might die in this land from which I migrated.' He (peace and blessings of Allah be upon him) said: 'I hope that you will live and some people will benefit from you and some will be harmed by you. O Allah, make the migration of my companions successful and do not turn them back on their heels, but I grieve for Sa'd bin Khawla, for he died in Makkah.'"

(١٢٥٦٧) عامر بن سعد اپنے والد سے نقل فرماتے ہیں کہ انھوں نے کہا : میں فتح مکہ کے سال بیمار ہوا، نبی (صلی اللہ علیہ وآلہ وسلم) نے میری عیادت کی۔ میں نے کہا : اے اللہ کے رسول ! میرے پاس مال زیادہ ہے اور میری وارث صرف ایک بیٹی ہے، کیا میں اپنے سارے مال کی وصیت کر دوں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں، میں نے کہا : نصف کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں میں نے کہا : ثلث کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے کہا : ثلث ٹھیک ہے اور ثلث بھی زیادہ ہے۔ اگر تو اپنے ورثا کو غنی چھوڑ، وہ اس سے بہتر ہے کہ تو ان کو محتاج چھوڑے اور وہ لوگوں کے سامنے ہاتھ پھیلاتے پھریں۔ بیشک تجھے تمام خرچ پر اجر ملے گا حتیٰ کہ اگر تو اپنی بیوی کے منہ میں لقمہ رکھے گا تو اس میں بھی اجر ہے۔ میں نے کہا : اے اللہ کے رسول ! مجھے ڈر ہے کہ میں فوت ہوجاؤں گا۔ اس زمین میں جہاں سے ہجرت کی تھی، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : مجھے امید ہے کہ تو زندہ رہے گا، یہاں تک کہ کچھ لوگ تجھ سے نفع حاصل کریں گے اور کچھ نقصان پائیں گے۔ اے اللہ ! میرے اصحاب کی ہجرت کو کامیاب بنا اور انھیں الٹے پاؤں واپس نہ کر، لیکن سعد بن خولہ پر افسوس ہے اس لیے کہ وہ مکہ میں فوت ہوگئے تھے۔
(12567) Aamir bin Saad apne walid se naql farmate hain ke unhon ne kaha : mein fatah makkah ke saal bimar hua, Nabi (Sallallaho Alaihi Wasallam) ne meri aiadat ki. mein ne kaha : aye Allah ke Rasool ! mere pass maal zyada hai aur meri waris sirf ek beti hai, kya mein apne sare maal ki wasiyat kar doon. Aap (Sallallaho Alaihi Wasallam) ne farmaya : nahi, mein ne kaha : nisf ki ? Aap (Sallallaho Alaihi Wasallam) ne farmaya : nahi mein ne kaha : suls ki ? Aap (Sallallaho Alaihi Wasallam) ne kaha : suls theek hai aur suls bhi zyada hai. Agar tu apne warasa ko ghani chhor, woh is se behtar hai ke tu un ko mohtaj chhore aur woh logon ke samne hath phelaate phiren. Beshak tujhe tamam kharch par ajr mile ga hatta ke agar tu apni biwi ke munh mein lukma rakhe ga to is mein bhi ajr hai. mein ne kaha : aye Allah ke Rasool ! mujhe dar hai ke mein faut hojaunga. is zameen mein jahan se hijrat ki thi, Aap (Sallallaho Alaihi Wasallam) ne farmaya : mujhe umeed hai ke tu zinda rahe ga, yahan tak ke kuch log tujh se nafa hasil karenge aur kuch nuksan payenge. aye Allah ! mere ashaab ki hijrat ko kamyab bana aur unhen ulte paon wapis na kar, lekin Saad bin Khaula par afsos hai is liye ke woh makkah mein faut hogaye the.
It is narrated in a hadith, "You will be rewarded for whatever you spend, even for a morsel of food you put in your wife's mouth." I said, "O Messenger of Allah! I will stay behind after your migration." He (peace and blessings of Allah be upon him) said, "If you live after me, and you act with the intention of Paradise, then your ranks will be raised, and perhaps you will live until some people benefit from you and some are harmed by you."

(١٢٥٦٨) ایک سند سے منقول ہے کہ تو جو بھی خرچ کرے گا تجھے اس کا اجر دیا جائے گا یہاں تک کہ ایک لقمہ جو تو اپنی بیوی کے منہ میں رکھے گا۔ میں نے کہا : اے اللہ کے رسول ! میں اپنی ہجرت سے پیچھے رہ جاؤں گا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تو میرے بعد زندہ رہے گا تو عمل کرے گا جنت کے ارادے سے تو تیرے درجات بلند ہوں گے اور شاید تو زندہ رہے یہاں تک کہ کچھ لوگ تجھ سے نفع اٹھائیں اور کچھ نقصان پائیں گے۔
(12568) Aik sand se manqol hai ke tu jo bhi kharch kare ga tujhe is ka ajr diya jaye ga yahan tak ke aik luqma jo tu apni biwi ke munh mein rakhe ga. Maine kaha : Aye Allah ke Rasool! mein apni hijrat se peeche reh jaunga, Aap ((صلى الله عليه وآله وسلم)) ne farmaya : Tu mere baad zinda rahe ga to amal kare ga jannat ke irade se to tere darjaat buland honge aur shayad tu zinda rahe yahan tak ke kuch log tujh se nafa uthayen aur kuch nuqsan payen ge.
Amir bin Sa'd narrated from his father that the Messenger of Allah (ﷺ) visited me (when I was sick). I said: "O Messenger of Allah, supplicate to Allah that He does not take my soul." He (ﷺ) said, "May Allah grant you good health, and make people benefit from you." I said: "I intend to make a will, but I only have a daughter. Shall I bequeath half of my wealth?" He (ﷺ) said, "Half is too much." I said: "One-third?" He (ﷺ) said, "One-third is enough, though even one-third is a lot." So, I bequeathed one-third of my wealth. And he (ﷺ) permitted me to do so.

(١٢٥٦٩) عامر بن سعد اپنے والد سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے میری عیادت کی۔ میں نے کہا : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! دعا کریں، اللہ مجھے واپس نہ لوٹائے، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ تجھے بلند کرے گا اور لوگ تجھ سے نفع اٹھائیں گے۔ میں نے کہا : میں وصیت کا ارادہ رکھتا ہوں اور میری صرف ایک بیٹی ہے، کیا نصف کی وصیت کر دوں ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نصف زیادہ ہے۔ میں نے کہا : ثلث کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ثلث ٹھیک اور ثلث بھی زیادہ ہے پس میں نے ثلث کی وصیت کی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے مجھے اجازت دے دی۔
(12569) Amir bin Saad apne walid se naql farmate hain keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne meri aiyadat ki. Main ne kaha: Aye Allah ke Rasul ((صلى الله عليه وآله وسلم))! Dua karen, Allah mujhe wapas na loutaye, Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Allah tujhe buland karega aur log tujh se nafa uthayenge. Main ne kaha: Main wasiyat ka irada rakhta hun aur meri sirf ek beti hai, kya nisf ki wasiyat kar dun? Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Nisf ziada hai. Main ne kaha: Sulth ki? Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Sulth theek aur sulth bhi ziada hai pas main ne sulth ki wasiyat ki. Aap ((صلى الله عليه وآله وسلم)) ne mujhe ijazat de di.
(12570) The words of a narration are: The Messenger of Allah (peace and blessings of Allah be upon him) came to me when I was ill. I said: O Messenger of Allah! Shall I bequeath all my wealth (as a will)? He (peace and blessings of Allah be upon him) said: No. I said: Then two-thirds? He (peace and blessings of Allah be upon him) said: No. I said: One-third then? He (peace and blessings of Allah be upon him) remained silent. So, I made a will for one-third.

(١٢٥٧٠) ایک سند کے الفاظ ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) میرے پاس آئے اور میں مریض تھا۔ میں نے کہا : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! میں اپنے سارے مال کی وصیت کر دوں ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں۔ میں نے کہا : دو ثلث کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں، میں نے کہا : ایک تہائی۔ آپ (صلی اللہ علیہ وآلہ وسلم) خاموش رہے، پس ثلث کی وصیت کی تھی۔

Narrated Abu Huraira (RA): The Messenger of Allah (ﷺ) said: Allah the Exalted has granted you one-third (of your property) in sadaqah on behalf of your deceased (relatives), as an addition to your good deeds, due to (your supplications for) them at the time of their death.

(١٢٥٧١) حضرت ابوہریرہ (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ تعالیٰ نے تم کو تمہارے مال کا ثلث دیا ہے، موت کے وقت تمہارے اعمال میں زیادتی کی وجہ سے۔
Hazrat Abu Hurairah (RA) se riwayat hai keh Rasool Allah (SAW) ne farmaya: Allah ta'ala ne tum ko tumhare maal ka suls diya hai, mout ke waqt tumhare amaal mein ziyadati ki wajah se.
(12572) It is narrated by Ibn Umar (may Allah be pleased with him) that Umar (may Allah be pleased with him) was asked about the will. Umar (may Allah be pleased with him) said: One-third is valid, neither less nor more.
(6) Chapter: It is considered preferable to keep the will below one-third if the heirs are not wealthy, based on the hadith of Sa'd ibn Abi Waqqas.

(١٢٥٧٢) ابن عمر (رض) سے روایت ہے کہ حضرت عمر (رض) سے وصیت کے بارے میں سوال کیا گیا تو حضرت عمر (رض) نی فرمایا : ثلث درست ہے نہ تھوڑی ہے اور نہ زیادہ۔
(٦) باب مَنِ اسْتَحَبَّ النُّقْصَانَ عَنِ الثُّلُثِ إِذَا لَمْ یَتْرُکْ وَرَثَتَہُ أَغْنِیَائَ اسْتِدْلاَلاً بِمَا رُوِّینَا فِی حَدِیثِ سَعْدِ بْنِ أَبِی وَقَّاصٍ
جس نے ثلث سے کم کو مستحب خیال کیا جب اس کے ورثاء غنی نہ ہوں حدیث سعد بن ابی وقاص سے استدلال کرتے ہوئے
(12572) Ibn Umar (RA) se riwayat hai ki Hazrat Umar (RA) se wasiyat ke baare mein sawal kiya gaya to Hazrat Umar (RA) ne farmaya: Sulth durust hai na thori hai aur na zyada.
(6) Bab Man istahabba al nuqsan an al sulth iza lam yatruk warasatahu aghniya' istidlalan bima ruwiya fi hadith Sa'd ibn Abi Waqqas
Jis ne sulth se kam ko mustahab khayaal kiya jab us ke warasa ghani na hon hadith Sa'd bin Abi Waqqas se istidlal karte hue.
