Chapter: The thief steals first, so his right hand is cut off from the wrist joint, then he is branded with fire
باب السارق يسرق أولا فتقطع يده اليمنى من مفصل الكف، ثم يحسم بالنار
Sunan al-Kubra Bayhaqi 17247
Mujahid, from [the recitation of] Ibn Mas'ud (may Allah be pleased with him) narrates: "The hand of a man or a woman who steals will be cut off." And similarly, Sufyan bin `Uyainah narrates. It is disconnected from Abu Najeih. And similarly, Ibrahim Nakha'i says: "Beware! It is in our recitation: the hand of a man or a woman who steals will be cut off."

(١٧٢٤٧) مجاہد ابن مسعود (رض) کی قراءت نقل فرماتے ہیں : چوری کرنے والا مرد ہو یا چوری کرنے والی عورت ان کا دایاں ہاتھ کاٹا جائے گا اور اسی طرح سفیان بن عیینہ بیان کرتے ہیں۔ ابی نجیح سے وہ روایت منقطع ہے اور اسی طرح ابراہمی نخعی فرماتے ہیں : خبردار ! وہ ہماری قرأت میں ہے چوری کرنے والے مرد ہوں یا وہ عورتیں ہوں ان کا دایاں ہاتھ کاٹا جائے گا۔
Mujahid Ibn Masood (RA) ki qirat naqal farmate hain : chori karne wala mard ho ya chori karne wali aurat un ka dayan hath kata jaye ga aur isi tarah Sufyan bin Uyainah bayan karte hain . Abi Najeh se wo riwayat munqata hai aur isi tarah Ibrahimi Nakh'i farmate hain : khabardar ! wo hamari qirat mein hai chori karne wale mard hon ya wo aurten hon un ka dayan hath kata jaye ga.
Umar bin Khattab (may Allah be pleased with him) used to cut the hand of a thief from the wrist, while Ali (may Allah be pleased with him) used to cut it from between the hand and the wrist.

(١٧٢٥١) حضرت عمر بن خطاب (رض) چور کا ہاتھ جوڑ سے کاٹتی اور حضرت علی (رض) ہاتھ ان دونوں کے درمیان سے کاٹتے تھے۔
Hazrat Umar bin Khattab (RA) chor ka hath jor se katte aur Hazrat Ali (RA) hath in donon ke darmiyaan se katte the.
(17253) Ali (may Allah be pleased with him) used to cut the foot, leaving the heel as a support. Ali (may Allah be pleased with him) used to differentiate between cutting the hand and the foot. He used to cut the hand from the wrist and the foot from half.

(١٧٢٥٣) حضرت علی (رض) پاؤں کاٹتے اور ایڑی چھوڑ دیتے جس پر وہ سہارا لے۔ حضرت علی (رض) ہاتھ اور پاؤں کاٹنے میں فرق کرتے۔ ہاتھ کو جوڑ سے کاٹتے اور پاؤں کو آدھے سے کاٹتے۔
(17253) Hazrat Ali (RA) paon kaatte aur eri chhor dete jis par woh sahara le. Hazrat Ali (RA) haath aur paon kaatne mein farq karte. Haath ko jor se kaatte aur paon ko aadhe se kaatte.
Abu Hurairah (may Allah be pleased with him) narrates that a thief was brought to the Prophet (peace and blessings of Allah be upon him) who had stolen a shawl. The people said: "O Messenger of Allah! He has committed theft." The Prophet (peace and blessings of Allah be upon him) said, "Does he confess to stealing?" The thief said, "Yes, O Messenger of Allah!" So he (the Prophet) said, "Take him away and cut off his hand." So they cut off his hand and cauterized it. Then they brought him back to the Prophet (peace and blessings of Allah be upon him), who said, "Seek repentance from Allah." So he repented, and Allah accepted his repentance.

(١٧٢٥٤) حضرت ابوہریرہ (رض) فرماتے ہیں کہ آپ (صلی اللہ علیہ وآلہ وسلم) کے پاس چور لایا گیا، جس نے چادر چوری کی تھی۔ انھوں نے کہا : اے اللہ کے رسول ! اس نے چوری کی ہے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کیا وہ چوری کا ارتکاب کرتا ہے ؟ چور نے کہا : کیوں نہیں اے اللہ کے رسول ! تو اسے فرمایا : اس کو لے جاؤ اور اس کے ہاتھ کاٹ دو ۔ پھر اس کو داغ دو ۔ پھر اس کو میرے پاس لے آؤ۔ اس کا ہاتھ کاٹا پھر آپ کے پاس لائے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ سے توبہ کر تو اس نے توبہ کی، اللہ نے اس کی توبہ قبول کی۔
Hazrat Abu Huraira (RA) farmate hain keh aap ((صلى الله عليه وآله وسلم)) ke pass chor laya gaya, jis ne chadar chori ki thi. Unhon ne kaha: Aye Allah ke Rasool! Is ne chori ki hai. Aap ((صلى الله عليه وآله وسلم)) ne farmaya: Kya woh chori ka irtikab karta hai? Chor ne kaha: Kyun nahi aye Allah ke Rasool! To use farmaya: Is ko le jao aur is ke hath kaat do. Phir is ko daagh do. Phir is ko mere pass le aao. Is ka hath kata phir aap ke pass laye to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Allah se tauba karo to us ne tauba ki, Allah ne us ki tauba qubool ki.
(17255) Abu Huraira (may Allah be pleased with him) narrated that he (the Prophet) cut off his hand, then cauterized it. Then he was brought to the Prophet (peace and blessings of Allah be upon him).

(١٧٢٥٥) حضرت ابوہریرہ (رض) نے اس کو ذکر کیا ہے کہ انھوں نے اس کا ہاتھ کاٹا، پھر اس کو داغا ۔ پھر اس کو لے کر آپ کیپ اس آئے۔
Hazrat Abu Huraira (RA) ne is ko zikar kiya hai keh unhon ne is ka hath kata phir is ko daagha phir is ko lekar aap ke paas aaye
Ali cut off the thief's hand from the wrist and put him in prison. When he recovered, Ali (R.A.) sent for him, brought him out and said: "Raise your hand towards Allah." He said, "We raised our hand." He said: "Who cut it off?" He said, "Ali (R.A.)." "Why?" He said: "We stole." They said: "O Allah! Be a witness, O Allah! Be a witness."

(١٧٢٥٧) حضرت علی (رض) نے چور کا ہاتھ جڑ سے کاٹا اور اس کو قید میں ڈال دیا۔ جب وہتندرست ہوا تو حضرت علی (رض) نے اس کی طرف پیغام بھیجا، اس کو نکالا۔ پھر کہا : اپنے ہاتھ اللہ کی طرف اٹھاؤ۔ وہ کہتے ہیں : ہم نے ہاتھ اٹھایا۔ وہ کہتے ہیں : آپ کو کس نے کاٹا : وہ کہتے : علی (رض) نے۔ کس لیے ؟ وہ کہتے : ہم نے چوری کی۔ انھوں نے کہا : اے اللہ گواہ ہوجا، اے اللہ ! گواہ ہوجا۔
Hazrat Ali (RA) ne chor ka hath jadh se kata aur is ko qaid mein dal diya. Jab woh tandrust hua to Hazrat Ali (RA) ne is ki taraf paigham bheja, is ko nikala. Phir kaha: Apne hath Allah ki taraf uthao. Woh kehte hain: Hum ne hath uthaya. Woh kehte hain: Aap ko kis ne kata: Woh kehte hain: Ali (RA) ne. Kis liye? Woh kehte hain: Hum ne chori ki. Unhon ne kaha: Aye Allah gawaah hoja, aye Allah! Gawaah hoja.
(17258) Ali (may Allah be pleased with him) says that when they used to catch a thief, they would cut off his hand, then brand him, and then imprison him. When he recovered and they intended to release him, they would say: Raise your hand towards Allah. He would say: Who cut off your hand? He would say: Ali (may Allah be pleased with him). They would say: O Allah! He has spoken the truth, it was I who cut off his hand and it was I who imprisoned him.
The Sheikh (may Allah have mercy on him) says: They used to rule during their time to the extent that they would become tyrants, but their hands would be branded as a form of punishment.
Ali (may Allah be pleased with him) says: Imprisoning an Imam after his prescribed punishment is an injustice.

(١٧٢٥٨) حضرت علی (رض) فرماتے ہیں کہ جب وہ چور کو پکڑتے، اس کے ہاتھ کاٹتے، پھر اس کو داغ دیتے۔ پھر اس کو جیل میں ڈال دیتے۔ جب وہ تندرست ہوا اور ارادہ کیا کہ ان کو نکالیں تو فرمایا : اللہ کی طرف ہاتھ اٹھاؤ۔ وہ کہہ رہے تھے : تمہارے ہاتھ کس نے کاٹے ؟ وہ کہتے : علی (رض) نے ۔ وہ کہتے : اے اللہ ! انھوں نے سچ کہا ہے جس میں میں نے ان کے ہاتھ کاٹے ہیں اور جس میں میں نے ان کو بھیجا تھا۔
شیخ (رح) فرماتے ہیں : وہ اپنے زمانے میں حکم کرتے تھے یہاں تک کے وہ بری ہوجاتے مگر ان کے ہاتھ تعزیری سزا کے طور پر داغے ہوتے۔
حضرت علی (رض) فرماتے ہیں : امام کو قید کرنا اس کی قائم حد کے بعد یہ ظلم ہے۔
(17258) Hazrat Ali (RA) farmate hain keh jab woh chor ko pakarte, uske hath katte, phir usko daagh dete. Phir usko jail mein daal dete. Jab woh tandarust hua aur irada kiya keh unko nikalen to farmaya : Allah ki taraf hath uthao. Woh keh rahe the : tumhare hath kisne kate ? Woh kehte : Ali (RA) ne . Woh kehte : aye Allah ! unhon ne sach kaha hai jis mein mein ne unke hath kate hain aur jis mein mein ne unko bheja tha.
Sheikh (RA) farmate hain : woh apne zamane mein hukm karte the yahan tak ke woh buri hojate magar unke hath ta'ziri saza ke tor par daaghe hote.
Hazrat Ali (RA) farmate hain : Imam ko qaid karna uski qaem had ke baad yeh zulm hai.
