Chapter: What is mentioned about confessing to theft and then retracting it. 'Ata' said: If one confesses once, his hand is cut off
باب ما جاء في الإقرار بالسرقة والرجوع عنه قال عطاء: إذا اعترف مرة قطع
Sunan al-Kubra Bayhaqi 17275
Narrated Abu Huraira (RA): A thief who had stolen a sheet was brought to the Messenger of Allah (ﷺ). He (ﷺ) asked him, "Did you steal this sheet?" He said, "Yes, O Messenger of Allah, I stole it." He (ﷺ) said, "Take him and cut off his hand." So they cut off his hand from the wrist. He (ﷺ) said: "Then cut it off from the root and bring him to me." So, he was brought and he (ﷺ) said: "Repent to Allah." He said: "I have repented to Allah." He (ﷺ) said: "Allah has accepted your repentance."

(١٧٢٧٥) ابوہریرہ (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس ایک چور لایا گیا۔ جس نے چادر چوری کی تھی تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے اس سے پوچھا : کیا تو نے یہ چادر چوری کی ؟ اس نے کہا : کیوں نہیں، اے اللہ کے رسول ! یہ میں نے چوری کی ہے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اس کو لے جاؤ اور اس کا ہاتھ کاٹ دو ۔ پھر اس کو جڑ سے کاٹ دو ، پھر میرے پاس لے کر آؤ۔ “ اس کو لایا گیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ” اللہ سے توبہ کر۔ “ اس نے کہا : میں نے اللہ سے توبہ کی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ” اللہ نے تیری توبہ قبول کی۔ “
(17275) Abu Hurairah (RA) se riwayat hai ki Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas ek chor laya gaya. Jis ne chadar chori ki thi to Rasul Allah ((صلى الله عليه وآله وسلم)) ne us se pucha : kya tune ye chadar chori ki? Us ne kaha : kyun nahi, aye Allah ke Rasul! Ye maine chori ki hai. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : is ko le jao aur is ka hath kaat do. Phir is ko jadd se kaat do, phir mere paas le kar aao. “ Is ko laya gaya to aap ((صلى الله عليه وآله وسلم)) ne farmaya : ” Allah se tauba kar. “ Us ne kaha : maine Allah se tauba ki. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : ” Allah ne teri tauba qubool ki. “
It is narrated on the authority of Abu Umayyah that a man stole something. He was caught stealing. He confessed. He was brought to the Prophet (peace and blessings of Allah be upon him). He (peace and blessings of Allah be upon him) said: "(I don't think you stole)." He said: "Yes!" He (peace and blessings of Allah be upon him) said these words three times. Then he (peace and blessings of Allah be upon him) ordered that his hand be cut off. Then, when his hand was cut off, he (peace and blessings of Allah be upon him) said: "Repent to Allah, the Exalted." He said: "I repent to Allah, the Exalted." So he (peace and blessings of Allah be upon him) said: "O Allah, accept his repentance."

(١٧٢٧٦) ابو امیہ سے روایت ہے کہ ایک آدمی نے کوئی سامان چوری کیا۔ وہ چوری کرتے ہوئے پکڑا گیا ۔ اس نے اعتراف کیا اس کو نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس لایا گیا۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا ( (لا إخالک سرقت) ) اس نے کہا : جی ہاں ! آپ (صلی اللہ علیہ وآلہ وسلم) نے یہ الفاظ تین مرتبہ فرمائے۔ پھر آپ (صلی اللہ علیہ وآلہ وسلم) نے ہاتھ کاٹنے کا حکم دیا۔ پھر جب ہاتھ کاٹا گیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تو اللہ تعالیٰ سے توبہ کر۔ اس نے کہا : میں اللہ تعالیٰ سے توبہ کرتا ہوں تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ” اے اللہ ! اس کی توبہ قبول فرما ! “
(17276) Abu Umayyah se riwayat hai ki ek aadmi ne koi saman chori kiya. Woh chori karte hue pakra gaya. Usne aitraaf kiya usko Nabi ((صلى الله عليه وآله وسلم)) ke paas laya gaya. Aap ((صلى الله عليه وآله وسلم)) ne farmaya ( (La Akhaalaka Saraq) ). Usne kaha: Ji haan! Aap ((صلى الله عليه وآله وسلم)) ne yeh alfaaz teen martaba farmaye. Phir Aap ((صلى الله عليه وآله وسلم)) ne haath kaatne ka hukum diya. Phir jab haath kata gaya to Aap ((صلى الله عليه وآله وسلم)) ne farmaya: To Allah Ta'ala se tauba kar. Usne kaha: Mein Allah Ta'ala se tauba karta hun to Aap ((صلى الله عليه وآله وسلم)) ne farmaya: “Aye Allah! Uski tauba kabool farma!”.
Narrated by Anas (RA): A thief was brought to Umar (RA). The thief said: I have never stolen before. Umar (RA) said: "You are lying. It is not befitting of Allah to expose a person's sin for the first time." Then his hand was cut off.

(١٧٢٧٧) حضرت انس (رض) سے روایت ہے کہ حضرت عمر (رض) کے پاس ایک چور لایا گیا۔ چور نے کہا : میں نے اس سے پہلے کبھی چوری نہیں کی۔ عمر (رض) نے فرمایا : ” تو جھوٹ کہہ رہا ہے۔ اللہ تعالیٰ کے لائق نہیں کہ وہ کسی بندے کا گناہ پہلی مرتبہ ظاہر کر دے۔ پھر اس کا ہاتھ کاٹا۔
Hazrat Anas (RA) se riwayat hai keh Hazrat Umar (RA) ke paas ek chor laya gaya. Chor ne kaha: mein ne is se pehle kabhi chori nahi ki. Umar (RA) ne farmaya: “Tu jhoot keh raha hai. Allah Taala ke laiq nahi keh woh kisi bande ka gunah pehli martaba zahir kar de.” Phir us ka hath kata.
It was narrated from Abu Darda' that a black slave woman was brought who had stolen. She was told (about the punishment for theft) and she said: "I stole." He said: "No, so she was let off."

(١٧٢٧٨) ابو درداء سے روایت ہے کہ ایک سیاہ لونڈی لائی گئی جس نے چوری کی تھی۔ اس کو کہا گیا تو کہتی ہے کہ میں نے چوری کی ہے۔ اس نے کہا : نہیں پس اس کو چھوڑ دیا۔
(17278) Abu Darda se riwayat hai keh aik siyah laundi laayi gayi jis ne chori ki thi. Us ko kaha gaya to kehti hai keh maine chori ki hai. Us ne kaha : nahi pas us ko chhor diya.
A woman who had stolen a camel was brought to Abu Mas'ud Ansari. Abu Mas'ud said, "Did you steal?" She said, "No."
It is narrated on the authority of Ibrahim that Umar bin al-Khattab (may Allah be pleased with him) said: Expel those who confess to crimes. Abu Sufyan said: That is, those who confess to crimes liable to ordained punishments will be banished.

(١٧٢٧٩) ابراہیم سے روایت ہے کہ ابو مسعود انصاری کے پاس ایک عورت کو لایا گیا جس نے ایک اونٹ چوری کیا تھا۔ ابو مسعود نے فرمایا : کیا تو نے چوری کی ہے اس نے کہا : نہیں۔
ابراہیم سے روایت ہے کہ حضرت عمر بن خطاب (رض) نے فرمایا : تم جلا وطن اعتراف کرنے والوں کو کرو۔ ابو سفیان کہتے ہیں : یعنی حدود سے اعتراف کرنے والوں کو نکالا جائے گا۔
