باب تحريم قتل ما له روح إلا بأن يذبح فيؤكل
Sunan al-Kubra Bayhaqi 18128
Abdullah bin Amr bin As narrated that the Messenger of Allah (ﷺ) said: “Whoever kills a sparrow or anything smaller, without a just reason, then Allah will question him about it.” It was asked: “What is its right, O Messenger of Allah?” He said: “That you slaughter it and eat it, and do not just cut off its head and throw it away.”
Imam Shafi said: The Messenger of Allah (ﷺ) forbade eating a sparrow that has been snared.

(١٨١٢٨) حضرت عبداللہ بن عمرو بن عاص فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس شخص نے چڑیا یا اس سے بھی چھوٹے پرندے کو ناحق قتل کیا تو اللہ رب العزت اس کے قتل کے بارے میں سوال کریں گے۔ پوچھا گیا : اے اللہ کے رسول ! اس کا حق کیا ہے ؟ فرمایا کہ آپ ذبح کر کے اس کو کھائیں، اس کا سر کاٹ کر پھینک نہ دیں۔
امام شافعی فرماتے ہیں رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے باندھی ہوئی چڑیا کے کھانے سے منع فرمایا۔
18128 Hazrat Abdullah bin Amro bin Aas farmate hain ke Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jis shakhs ne chidiya ya is se bhi chhote parinde ko nahaq qatal kiya to Allah Rab ul Izzat is ke qatal ke bare mein sawal karenge. Poocha gaya: Aye Allah ke Rasool! Is ka haq kya hai? Farmaya ke aap zibah kar ke is ko khaen, is ka sar kaat kar phenk na dein.
Imam Shafi farmate hain Rasool Allah ((صلى الله عليه وآله وسلم)) ne bandhi hui chidiya ke khane se mana farmaya.
Hisham bin Zaid said: I came with Anas (may Allah be pleased with him) to Hukm bin Ayub. He saw children or young people aiming at a hen, having tied it up. Anas (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings of Allah be upon him) prohibited taking living animals as targets.

(١٨١٢٩) ہشام بن زید کہتے ہیں : میں حضرت انس (رض) کے ساتھ حکم بن ایوب کے پاس آیا۔ انھوں نے بچوں یا نوجوانوں کو دیکھا کہ وہ ایک مرغی کو نسب کر کے نشانہ بازی کر رہے ہیں۔ حضرت انس (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے چوپایوں کو باندھنے سے منع فرمایا ہے۔
(18129) Hisham bin Zaid kehte hain : mein Hazrat Anas (RA) ke sath Hukm bin Ayub ke paas aaya. Unhon ne bachchon ya naujawanon ko dekha keh woh ek murgi ko nisab kar ke nishana bazi kar rahe hain. Hazrat Anas (RA) farmate hain keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne chopayon ko bandhne se mana farmaya hai.
Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) forbade tying up an animal and then slaughtering it.

(١٨١٣٠) جابر (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے کسی چوپائے کو باندھ کر قتل کرنے سے منع فرمایا ہے۔
(18130) jabir (rz) farmate hain keh rasool allah ((صلى الله عليه وآله وسلم)) ne kisi chopaye ko bandh kar qatal karne se mana farmaya hai.
Yahya bin Saeed narrates that Abu Bakr Siddiq (may Allah be pleased with him) sent armies towards Syria. He mentioned the hadith regarding his will, at the end of which is that goats and camels should only be slaughtered for eating.

(١٨١٣١) یحییٰ بن سعید فرماتے ہیں کہ ابوبکر صدیق (رض) نے شام کی طرف لشکر بھیجے۔ ان کی وصیت کے بارے میں حدیث کو ذکر کیا، جس کے آخر میں ہے کہ بکری اور اونٹ کو صرف کھانے کے لیے ذبح کیا جائے۔
Yahya bin Saeed farmate hain ke Abu Bakr Siddiq (RA) ne Sham ki taraf lashkar bheje. Un ki wasiyat ke bare mein hadees ko zikr kya, jis ke akhir mein hai ke bakri aur unt ko sirf khane ke liye zibah kya jaye.
Abu Imran Johni said that Abu Bakr (may Allah be pleased with him) sent Yazid bin Abi Sufyan towards Syria. He narrated a hadith, at the end of which it is stated: "And you slaughter camels and cows only for eating."

(١٨١٣٢) ابو عمران جونی فرماتے ہیں کہ حضرت ابوبکر (رض) نے یزید بن ابی سفیان کو شام کی طرف بھیجا۔ اس نے حدیث ذکر کی جس کے آخر میں ہے کہ تم اونٹ اور گائے کو صرف کھانے کے لیے ذبح کرو۔
(18132) abu imran jooni farmate hain ki hazrat abubakar (rz) ne yazid bin abi sufyan ko shaam ki taraf bheja usne hadees zikar ki jis ke akhir mein hai ki tum unt aur gay ko sirf khane ke liye zibah karo.
Muadh ibn Jabal (may Allah be pleased with him) was asked: “The Romans capture our horses and other animals and kill them. Should we kill our horses (in retaliation)?” He replied: “No, they are not worthy of you taking revenge from them. Tomorrow they will either be your slaves or your protected subjects (dhimmi).”

(١٨١٣٣) حضرت معاذ بن جبل (رض) سے کہا گیا : رومیوں کو ہمارے جو گھوڑے وغیرہ ہاتھ لگتے ہیں تو وہ انھیں قتل کردیتے ہیں۔ کیا ہم اپنے گھوڑوں کو قتل کردیں۔ انھوں نے فرمایا : نہیں، وہ اس لائق نہیں کہ وہ تم سے انتقام لیں۔ کل وہ تمہارے غلام ہوں گے یا اہل ذمہ۔
Hazrat Muaz bin Jabal (RA) se kaha gaya: Rumiyon ko hamare jo ghore waghaira hath lagte hain to wo unhen qatl kar dete hain. Kya hum apne ghoron ko qatl kar dein. Unhon ne farmaya: Nahin, wo is layeq nahin ki wo tum se inteqam len. Kal wo tumhare ghulam honge ya ahl zimma.
Abdullah bin Umar (RA) narrated that I heard the Messenger of Allah (ﷺ) saying: Allah has cursed the one who mutilates the dead animals.
Grade: Sahih
(١٨١٣٤) حضرت عبداللہ بن عمر (رض) فرماتے ہیں : میں نے رسول اللہ سے سنا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ اس شخص پر لعنت کرے جو حیوانوں کا مثلہ کرتا ہے۔
(18134) Hazrat Abdullah bin Umar (RA) farmate hain : maine rasool Allah se suna, aap ((صلى الله عليه وآله وسلم)) ne farmaya : Allah us shakhs par laanat kare jo janwaron ka misla karta hai.
Abu Raham Samayee narrates that the Messenger of Allah (peace and blessings be upon him) said: "Whoever slaughters a quadruped animal, a quarter of his reward is nullified. Whoever burns a honeybee, a quarter of his reward is also nullified. And whoever deceives his fellow human being, a quarter of his reward is nullified. And whoever disobeys the Imam, his entire reward is nullified."

(١٨١٣٥) ابو رہم سماعی فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے چوپائے کو ذبح کیا، اس کا چوتھائی حصہ اجر ختم ہوگیا۔ جس نے شہد کی مکھی کو جلایا، اس کا بھی چوتھائی حصہ اجر ختم ہوگیا اور جس شخص نے اپنے حصہ دار انسان سے دھوکا کیا اس کا بھی چوتھائی اجر ختم ہوگیا اور جس نے امام کی نافرمانی کی اس کا مکمل اجر ختم ہوگیا۔
(18135) Abu Raham Samai farmate hain ki Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jis ne chopaye ko zabah kiya, us ka chauthai hissa ajr khatam hogaya. Jis ne shahad ki makhi ko jalaya, us ka bhi chauthai hissa ajr khatam hogaya aur jis shakhs ne apne hissa dar insaan se dhoka kiya us ka bhi chauthai ajr khatam hogaya aur jis ne imam ki nafarmani ki us ka mukammal ajr khatam hogaya.
Yahya bin 'Abbad bin Abdullah bin Zubair narrated from his father, who said, "The one who breastfed me was from the tribe of Murrah bin 'Awf. He said, 'By Allah! It was as if I were looking at Ja'far bin Abi Talib on the Day of the Battle of Mu'tah when he dismounted his reddish-white horse and slaughtered it. Then he advanced and fought until he was martyred.'"

(١٨١٣٦) یحییٰ بن عباد بن عبداللہ بن زبیر اپنے والد سے نقل فرماتے ہیں کہ میرے والد جس نے مجھے دودھ پلوایا مرہ بن عوف کے ایک شخص تھے، فرماتے ہیں کہ قسم بخدا ! گویا کہ میں جعفر بن ابی طالب کی طرف جنگ موتہ کے دن دیکھ رہا ہوں جس وقت وہ اپنے شقراء گھوڑے سے کود پڑے، اس کو ذبح کردیا۔ پھر آگے بڑھ کر لڑے یہاں تک کہ شہید کردیے گئے۔
(18136) Yahya bin Abbad bin Abdullah bin Zubair apne walid se naql farmate hain ke mere walid jisne mujhe doodh pilawaya Marra bin Auf ke aik shakhs the, farmate hain ke qasam bikhoda! Goya ke main Jaafar bin Abi Talib ki taraf jang mota ke din dekh raha hun jis waqt wo apne shuqra ghore se kood parre, us ko zibah kardiya. Phir aage barh kar larre yahan tak ke shaheed kardiye gaye.
Imam Shafi'i (may Allah have mercy on him) said: If someone were to say that Ja'far ibn Abi Talib cut the reins of his horse during battle, (I would say) I do not recall this, nor is it famous among the people of knowledge.

(١٨١٣٧) امام شافعی (رح) فرماتے ہیں : اگر کوئی کہنے والا کہے کہ جعفر بن ابی طالب نے لڑائی کے موقعہ پر اپنے گھوڑے کی کونچیں کاٹ ڈالیں۔ فرماتے ہیں : نہ تو مجھے یاد ہے اور نہ ہی اہل علم کے ہاں یہ مشہور ہے۔
(18137) Imam Shafi (rah) farmate hain : agar koi kahne wala kahe ke Ja'far bin Abi Talib ne larai ke mauqa par apne ghore ki konchein kaat dali. Farmate hain : na to mujhe yaad hai aur na hi ahl e ilm ke han ye mashhoor hai.
(18138) Abu Dawud Sijistani said: This hadith is not strong, and it is narrated from many of the companions.
The Sheikh said: If this is true, then it is possible that Ja'far (may Allah be pleased with him) did not know about the prohibition.

(١٨١٣٨) ابوداؤد سجستانی فرماتے ہیں : یہ حدیث قوی نہیں ہے، اس کے بارے میں بہت سارے صحابہ سے بھی منقول ہے۔
شیخ فرماتے ہیں : اگر یہ بات درست ہے تو ممکن ہے کہ حضرت جعفر (رض) کو نہی کے بارے میں علم نہ ہو۔
(18138) Abu Dawood Sijistani farmate hain : yeh hadees qawi nahin hai, is ke bare mein bahut sare sahaba se bhi manqol hai.
Shaikh farmate hain : agar yeh baat durust hai to mumkin hai ke Hazrat Ja'far (Raz) ko nahi ke bare mein ilm na ho.
