Chapter: Two plaintiffs disputing over something not in either of their hands, and each establishes proof for his claim
باب المتداعيين يتداعيان ما لم يكن في يد واحد منهما، ويقيم كل واحد منهما بينة بدعواه
Sunan al-Kubra Bayhaqi 21235
Saeed bin Musayyab narrated that two men came to the Prophet (peace and blessings of Allah be upon him) with a dispute. They both presented just witnesses. He (peace and blessings of Allah be upon him) cast lots between them and said: "O Allah! Decide between them." Then he (peace and blessings of Allah be upon him) ruled in favor of the one whose lot was drawn.

(٢١٢٣٥) سعید بن مسیب فرماتے ہیں کہ دو آدمی جھگڑا لے کر نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئے۔ دونوں نے عادل گواہ بھی پیش کیے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے دونوں کے درمیان قرعہ ڈالا اور فرمایا : اے اللہ ! تو ان کے درمیان فیصلہ فرما۔ پھر آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کے حق میں فیصلہ فرمایا جس کا قرعہ نکلا۔
(21235) Saeed bin Musayeb farmate hain keh do aadmi jhagra lekar Nabi ((صلى الله عليه وآله وسلم)) ke pass aaye. Donon ne adil gawah bhi pesh kiye. Aap ((صلى الله عليه وآله وسلم)) ne donon ke darmiyan qura dala aur farmaya: Aye Allah! Tu in ke darmiyan faisla farma. Phir aap ((صلى الله عليه وآله وسلم)) ne uske haq mein faisla farmaya jis ka qura nikla.
Sulaiman bin Yasar narrates that two men came to the Prophet (peace and blessings of Allah be upon him) with a dispute, and they had witnesses with them. The Prophet (peace and blessings of Allah be upon him) cast lots between them.

(٢١٢٣٦) سلیمان بن یسار فرماتے ہیں کہ دو آدمی نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس جھگڑا لے کر آئے تو ان کے پاس گواہ بھی موجود تھے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے دونوں کے درمیان قرعہ اندازی فرمائی۔
21236 Sulaiman bin Yasar farmate hain keh do aadmi Nabi ((صلى الله عليه وآله وسلم)) ke paas jhagra lekar aaye to un ke paas gawah bhi mojood thay. Aap ((صلى الله عليه وآله وسلم)) ne donon ke darmiyan qur'a andazi farmai.
Simak narrates from Hunsh that a mule that had been sold in the market was brought to Ali (may Allah be pleased with him). One man said, "This mule is mine, I neither gifted it nor sold it," and presented five witnesses. Another man also claimed the mule and presented two witnesses. Ali (may Allah be pleased with him) said, "The decision and settlement of this is that the mule should be sold and divided into seven shares. The one who presented five witnesses will be given five shares, and the other will be given two shares. If you want the decision based on truth, then one of the two should take an oath that this mule is his, and he did not sell or gift it. If you both agree to this, then I will cast lots for the oath. Whoever's lot is drawn will take the oath." Then the matter was settled in this manner. I bear witness to this.

(٢١٢٣٧) سماک حضرت حنش سے نقل فرماتے ہیں کہ حضرت علی (رض) کے پاس بازار میں فروخت ہوئی کوئی خچر لائی گئی۔ ایک آدمی نے کہہ دیا : یہ خچر میری ہے، نہ تو میں نے ہبہ کیا اور نہ ہی فروخت اور پانچ گواہ پیش کردیے۔ دوسرے نے بھی خچر کا دعویٰ کردیا اور دو گواہ بھی پیش کردیے۔ تو حضرت علی (رض) فرمانے لگے : اس کا فیصلہ اور صلح بھی ہے کہ خچر کو فروخت کر کے سات حصوں میں تقسیم کر دو ۔ جس نے پانچ گواہ پیش کیے ہیں، اس کو پانچ حصے دیے جائیں، دوسرے کو دو حصے دے دو ۔ اگر حق کا فیصلہ مطلوب ہے تو دونوں میں سے ایک قسم اٹھائے کہ یہ خچر اس کی ہے، اس نے فروخت اور ہبہ نہیں کی۔ اگر تم اس پر راضی ہو تو میں قسم کے لیے قرعہ اندازی کردیتا ہوں۔ جس کا قرعہ نکلا وہ قسم اٹھائے گا۔ پھر اس طرح فیصلہ ہوا میں گواہ ہوں۔
21237 Samak Hazrat Hanash se naqal farmate hain ke Hazrat Ali (RA) ke paas bazaar mein farokht hui koi khachar laayi gayi. Ek aadmi ne keh diya: Yeh khachar meri hai, na to maine hiba kiya aur na hi farokht aur panch gawah pesh kar diye. Dusre ne bhi khachar ka daawa kar diya aur do gawah bhi pesh kar diye. To Hazrat Ali (RA) farmane lage: Iska faisla aur sulah bhi hai ke khachar ko farokht kar ke saat hisson mein taqseem kar do. Jisne panch gawah pesh kiye hain, usko panch hisse diye jayen, dusre ko do hisse de do. Agar haq ka faisla matloob hai to donon mein se ek qasam uthaye ke yeh khachar uski hai, usne farokht aur hiba nahin ki. Agar tum is par raazi ho to main qasam ke liye quraa andazi kar deta hun. Jiska quraa nikla woh qasam uthayega. Phir is tarah faisla hua main gawah hun.
(21238) Abu Rafi' narrated from Hadrat Abu Hurairah (may Allah be pleased with him) that when both parties present one witness each, I will draw lots between them, because the Prophet (peace and blessings of Allah be upon him) did the same.
(B) Abu Rafi' narrated from Hadrat Abu Hurairah (may Allah be pleased with him) that two people came to the Prophet (peace and blessings of Allah be upon him) with a dispute. Neither of them had a witness. The Prophet (peace and blessings of Allah be upon him) said: "Cast lots between them for an oath."
Imam Shafi'i (may Allah have mercy on him) said: "There will be an equal division between them; because the evidence is equal on both sides."

(٢١٢٣٨) ابو رافع حضرت ابوہریرہ (رض) سے نقل فرماتے ہیں کہ جب دونوں فریق ایک ایک گواہ پیش کردیں تو میں ان کے درمیان قرعہ اندازی کروں گا، کیونکہ نبی (صلی اللہ علیہ وآلہ وسلم) نے بھی ایسا کیا تھا۔
(ب) ابورافع حضرت ابوہریرہ (رض) سے نقل فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس دو شخص جھگڑا لے کر آئے۔ دونوں میں سے کسی کے پاس گواہ نہ تھے۔ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : دونوں کے درمیان قسم کے لیے قرعہ ڈال لو۔
امام شافعی (رح) فرماتے ہیں : ان میں برابر تقسیم ہوگا؛ کیونکہ دلائل دونوں کے پاس برابر ہیں۔
(21238) Abu Rafi Hazrat Abu Hurairah (RA) se naqal farmate hain ke jab donon fareeq ek ek gawah pesh kar den to main un ke darmiyan qur'a andazi karunga, kyunki Nabi ((صلى الله عليه وآله وسلم)) ne bhi aisa kiya tha.
(b) Abu Rafi Hazrat Abu Hurairah (RA) se naqal farmate hain ke Nabi ((صلى الله عليه وآله وسلم)) ke paas do shakhs jhagda le kar aaye. Donon mein se kisi ke paas gawah na the. Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Donon ke darmiyan qasam ke liye qur'a daal lo.
Imam Shafi (RA) farmate hain: Un mein barabar taqseem hoga; kyunki dalail donon ke paas barabar hain.
Sa'eed bin Abi Burda reported from his father, who reported from Abu Musa, that two men claimed a camel and each of them produced two witnesses. So the Prophet (ﷺ) divided it between them, but it is not mentioned in this narration whether the camel was or was not in the possession of either of them.

(٢١٢٣٩) سعید بن ابی بردہ اپنے والد سے نقل فرماتے ہیں جو ابوموسیٰ سے روایت فرماتے ہیں کہ دو آدمیوں نے ایک اونٹ کا دعویٰ کردیا اور دو دو گواہ بھی پیش کردیے۔ تو نبی (صلی اللہ علیہ وآلہ وسلم) نے ان کے درمیان تقسیم کردیا، لیکن اس میں یہ تذکرہ نہیں کہ اونٹ دونوں میں سے کسی کے ہاتھ میں نہ تھا۔
(21239) Saeed bin Abi Burda apne walid se naql farmate hain jo Abu Musa se riwayat farmate hain ke do admiyon ne ek unt ka daawa kardiya aur do do gawah bhi pesh kardiye. To Nabi ((صلى الله عليه وآله وسلم)) ne un ke darmiyan taqseem kardiya, lekin is mein ye tazkira nahin ke unt donon mein se kisi ke hath mein na tha.
Tamim bin Tarafa narrated that two men disputed over a camel and they brought witnesses. So you (the Prophet, peace and blessings be upon him) divided it equally between them.

(٢١٢٤٠) تمیم بن طرفہ فرماتے ہیں کہ دو آدمیوں نے ایک اونٹ کا جھگڑا پیش کیا اور گواہ بھی حاضر کردیے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے ان کے درمیان برابر تقسیم کردیا۔
(21240) tameem bin tarafa farmate hain ke do aadmiyon ne ek oont ka jhagda pesh kiya aur gawah bhi hazir kardiye aap ne un ke darmiyaan barabar taqseem kardiya
'Abdur-Rahman bin Abi Layla reported: I went to Abu Darda'. Some people brought a dispute about a mare. Both parties brought witnesses that the animal had given birth with them, so the Prophet (ﷺ) decided between them.

(٢١٢٤١) عبدالرحمن بن ابی لیلی فرماتے ہیں کہ میں ابو درداء کے پاس آیا۔ ایک قوم نے ایک گھوڑے کا جھگڑا پیش کیا۔ دونوں فریقوں نے گواہ بھی پیش کیے کہ چوپائے نے ان کے پاس جنم دیا ہے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے ان کے درمیان فیصلہ فرما دیا۔
21241 Abdur Rahman bin Abi Laila farmate hain ki mein Abu Darda ke pass aya Ek qaum ne ek ghore ka jhagra pesh kiya Donon fariqon ne gawah bhi pesh kiye ke chopaye ne unke pass janam diya hai to aap ne unke darmiyan faisla farma diya
(21242) Abdul Rahman bin Abi Laila narrated that two men had a dispute over a horse. They both presented arguments that it was born in their possession. He did not sell or gift it, so Abu Darda said: One of you is lying, and he divided it equally between them.
Imam Shafi'i (may Allah have mercy on him) said: I would abstain in such a matter. Both of them should be given something in case of reconciliation, otherwise nothing should be given.

(٢١٢٤٢) عبدالرحمن بن ابی یعلی فرماتے ہیں کہ دو آدمیوں نے گھوڑے کا جھگڑا پیش کیا۔ دونوں نے دلائل بھی پیش کیے کہ اس نے ان کے ہاں جنم لیا ہے۔ اس نے فروخت یا ہبہ نہیں کیا تو ابودردا فرمانے لگے : تم دونوں میں سے ایک جھوٹا ہے اور ان میں برابر تقسیم کردیا۔
امام شافعی (رح) فرماتے ہیں : اس طرح کے مسئلہ میں توقف اختیار کرتا ہوں۔ ان دونوں کو صلح کی صورت میں کچھ دیا جائے، وگرنہ کچھ بھی نہ دیا جائے۔
(21242) abdul rehman bin abi yaala farmate hain ke do admiyon ne ghore ka jhagra pesh kya dono ne daleel bhi pesh kiye ke usne un ke han janam liya hai usne farokht ya hiba nahi kya to abudurda farmane lage tum dono mein se ek jhoota hai aur un mein barabar taqsim kar diya imam shafi (rh) farmate hain is tarah ke masle mein taqaf ikhtiyar karta hun in dono ko sulh ki surat mein kuch diya jaye warna kuch bhi na diya jaye
Abdul Rahman bin Abi Laila said: I was sitting with Abu Darda (may Allah be pleased with him) when he narrated a similar hadith, that he found a man with his horse.
Imam Shafi'i (may Allah have mercy on him) said: I would hesitate in such a case. If they make peace, they should be given something; otherwise, they should not be given anything.

(٢١٢٤٣) عبدالرحمن بن ابی یعلی فرماتے ہیں کہ میں ابودرداء (رض) کے پاس بیٹھا ہوا تھا۔ اسی جیسی حدیث بیان کی کہ انھوں کے گھوڑے کے ساتھ ایک آدمی کو بھی پایا۔
امام شافعی (رح) فرماتے ہیں : اس طرح کے مسئلہ میں توقف اختیار کرتا ہوں۔ ان دونوں کو صلح کی صورت میں کچھ دیا جائے وگرنہ کچھ بھی نہ دیا جائے۔
(21243) abdulrehman bin abi yaala farmate hain keh main abudurda (raz) ke pass baitha hua tha isi jaisi hadees bayan ki keh unhon ke ghore ke sath ek aadmi ko bhi paya
imam shafai (rah) farmate hain is tarah ke masle mein taqaf ikhtiyar karta hun in donon ko sulah ki surat mein kuch diya jaye warna kuch bhi na diya jaye
Sayyida Umm Salama (may Allah be pleased with her) narrated that two Ansar came to the Prophet (peace and blessings of Allah be upon him) disputing over an inheritance. They knew (the rightful inheritors) but those whom they knew had passed away. The Prophet (peace and blessings of Allah be upon him) said: “I am only a human, and nothing from the heavens has been revealed to me in this regard. So I will judge between you according to my own opinion. If I were to judge in favor of one of you regarding his brother’s share, it would be like giving him a burning ember of fire.” Both of them started crying and said: “O Messenger of Allah, give his right to him!” The Prophet (peace and blessings of Allah be upon him) then said: “Go and divide the inheritance between yourselves amicably, establish ties of brotherhood, then draw lots. Whatever comes out for each of you will be lawful for him.”

(٢١٢٤٤) سیدہ ام سلمہ (رض) فرماتی ہیں کہ دو انصاری وراثت کا جھگڑا لے کر آئے، وہ جانتے تھے لیکن جن کو پہچان تھی وہ فوت ہوگئے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میں انسان ہوں جس کے بارے میں میرے اوپر کچھ نازل نہیں ہوا ، میں اپنی رائے سے فیصلہ کروں گا۔ جس کے لیے میں اس کے بھائی کے حق کا فیصلہ فرما دوں تو گویا آگ کا انگارہ دے رہا ہوں، وہ دونوں رو رہے تھے اور کہنے لگے : میرا حق اس کو دے دیں اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جاؤ آپس میں تقسیم کرلو۔ بھائی چارہ قائم کرلو۔ پھر قرعہ اندازی کرلو۔ پھر ہر ایک کے لیے جائز ہوگا۔
(21244) Sayyidah Umme Salma (Razi Allah Anha) farmati hain ke do Ansaari wirath ka jhagra lekar aaye, woh jaante thay lekin jin ko pehchaan thi woh faut hogaye. Aap ((صلى الله عليه وآله وسلم)) ne farmaya: mein insaan hun jis ke baare mein mere upar kuch nazil nahi hua, mein apni raay se faisla karunga. Jis ke liye mein us ke bhai ke haq ka faisla farma dun to goya aag ka angara de raha hun, woh dono ro rahe thay aur kehne lage: mera haq is ko de den aye Allah ke Rasool ((صلى الله عليه وآله وسلم))! Aap ((صلى الله عليه وآله وسلم)) ne farmaya: jao aapas mein taqseem karlo. Bhai chaar qaayam karlo. Phir qur'a andazi karlo. Phir har ek ke liye jaiz hoga.
