١٦١٣٩ - أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، بِبَغْدَادَ، أنبأ أَحْمَدُ بْنُ عُثْمَانَ بْنِ يَحْيَى الْآدَمِيُّ، ثنا إِبْرَاهِيمُ بْنُ الْهَيْثَمِ، ثنا الْهَيْثَمُ بْنُ جَمِيلٍ، ثنا مُحَمَّدُ بْنُ رَاشِدٍ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ،قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ:" مَنْ قَتَلَ عَمْدًا دُفِعَ إِلَى وَلِيِّ الْمَقْتُولِ، فَإِنْ شَاءَ قَتَلَهُ، وَإِنْ شَاءَ أَخَذَ الدِّيَةَ، وَهِيَ ثَلَاثُونَ حِقَّةً، وَثَلَاثُونَ جَذَعَةً، وَأَرْبَعُونَ خَلِفَةً، وَذَلِكَ عَقْلُ الْعَمْدِ، وَمَا صُولِحُوا عَلَيْهِ فَهُوَ لَهُمْ، وَذَلِكَ تَشْدِيدُ الْعَقْلِ "
