Chapter on what is mentioned about taking a piece of wood from the sanctuary of Medina or hitting a prey with it.
باب ما ورد في سلب من قطع من شجر حرم المدينة أو أصاب فيه صيدا
Sunan al-Kubra Bayhaqi 9972
Amir bin Sa'd reported that Sa'd went riding towards a place called 'Aqiq to his house. He found a slave of his cutting a tree. He snatched it from him. When the slave went back home, his masters came and demanded that he return what he had taken from their slave. He said: "I seek refuge in Allah. May Allah protect me from returning anything which Allah's Messenger ( صلی اللہ علیہ وسلم ) granted me as Fay' (spoils of war) and I will not return anything to any of them."

(٩٩٧٢) عامر بن سعد کہتے ہیں کہ سعد عقیق نامی جگہ کی طرف سوار ہو کر اپنے گھر گئے۔ انھوں نے ایک غلام کو پایا وہ درخت کاٹ رہا تھا۔ انھوں نے ان سے چھین لیا۔ جب وہ غلام گھر واپس گیا تو اس کے گھر والے آگئے۔ وہ سوال کر رہے تھے کہ واپس کریں جو ان کے غلام سے لیا گیا ہے۔ کہنے لگے : معاذ اللہ ! اللہ کی پناہ کہ میں کوئی چیز واپس کروں جو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے مجھے غنیمت میں دی ہے اور ان کی طرف کچھ بھی واپس نہ کیا۔
(9972) Amir bin Sad kehte hain ki Sad Aqeek naami jaga ki taraf sawar ho kar apne ghar gaye. Unhon ne ek ghulam ko paya woh darakht kaat raha tha. Unhon ne un se chhen liya. Jab woh ghulam ghar wapas gaya to uske ghar wale aaye. Woh sawal kar rahe the ki wapas karen jo unke ghulam se liya gaya hai. Kehne lage : Moaz Allah ! Allah ki panaah ki mein koi cheez wapas karoon jo Rasool Allah ((صلى الله عليه وآله وسلم)) ne mujhe ghanimat mein di hai aur un ki taraf kuchh bhi wapas na kiya.
(9973) It is narrated from the children of Abdullah bin Ja’far Masur bin Mukhramh that he found a slave cutting a tree or shaking its leaves, so he took it from him. At the end of it is that he refused to return it. [Sahih Muslim].

(٩٩٧٣) عبداللہ بن جعفر مسور بن مخرمہ کی اولاد سے نقل فرماتے ہیں کہ انھوں نے ایک غلام کو درخت کاٹتے ہوئے یا پتے جھاڑتے ہوئے پایاتو اس سے چھین لیا۔ اس کے آخر میں ہے کہ اس نے واپس کرنے سے انکار کردیا۔ [صحیح۔ انظر قبلہ ]
9973 abdullah bin jaafar masoor bin mukhrama ki aulad se naql farmate hain ki unhon ne ek ghulam ko darakht katte huye ya patte jhaarte huye paya to us se chhen liya is ke aakhir mein hai ki us ne wapas karne se inkar kar diya sahih anzar qibla
(9974) The children of Sa'd narrated from Sa'd that the Messenger of Allah (peace be upon him) said: "Whoever you find cutting down a tree in the sanctuary of Medina, his belongings are for you. It is not permissible to cut or uproot its trees." The narrator said: Sa'd found two slaves cutting down a tree, so he took their belongings. They went to their masters and informed them that Sa'd had done such and such. They came and said: "O Abu Ishaq! Your slaves have seized the belongings of our slaves." He said: "I have taken it. I heard from the Messenger of Allah (peace be upon him) that whoever you find cutting down a tree in the sanctuary, his belongings are for you. However, you can question me about my belongings as you wish."

(٩٩٧٤) سعد کی اولاد حضرت سعد سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس کو تم پکڑ لو کہ وہ حرم مدینہ سے درخت کاٹ رہا ہے۔ اس کی سلب یعنی سامان تمہارے لیے ہے۔ اس کے درختوں کا کاٹنا یا اکھاڑنا درست نہیں ہے۔ راوی فرماتے ہیں کہ حضرت سعد نے دو غلاموں کو درخت کاٹتے ہوئے پایا تو ان کا سامان لے لیا۔ وہ اپنے آقاؤں کے پاس گئے ان کو خبر دی کہ سعد نے اس طرح کیا ہے ؟ وہ آئے انھوں نے کہا : اے ابواسحاق ! تیرے غلاموں نے ہمارے غلاموں کا سامان چھین لیا ہے، فرمانے لگے : میں نے چھینا ہے۔ میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے سنا ہے کہ جس کو تم پکڑ لو کہ وہ حرم کے درخت کاٹ رہا ہو تو، اس کا سامان تمہارے لیے ہے، لیکن تم میرے مال کے بارے میں سوال کرو جو تم چاہو۔
(9974) Saad ki aulad Hazrat Saad se naqal farmate hain ki Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jis ko tum pakar lo ki woh haram Madina se darakht kaat raha hai, us ki salb yani saman tumhare liye hai. Is ke darakhton ka kaatna ya ukharna durust nahin hai. Rawi farmate hain ki Hazrat Saad ne do ghulamon ko darakht kaatte hue paya to un ka saman le liya. Woh apne aaqaon ke paas gaye un ko khabar di ki Saad ne is tarah kya hai? Woh aaye unhon ne kaha: Ae Abu Ishaq! Tere ghulamon ne hamare ghulamon ka saman chheen liya hai. Farmane lage: Maine chheena hai. Maine Rasool Allah ((صلى الله عليه وآله وسلم)) se suna hai ki jis ko tum pakar lo ki woh haram ke darakht kaat raha ho to us ka saman tumhare liye hai, lekin tum mere maal ke bare mein sawal karo jo tum chaho.
Amir bin Sa’d narrated on the authority of his father that he (his father) went out from Medina and found with Hatib green trees which he had cut from the trees of Medina. He (Sa’d) took his belongings. There was a talk about it. He (Hatib) said: I will not leave the property that Allah's Messenger (ﷺ) has granted me, even though I be the richest of all men.

(٩٩٧٥) عامر بن سعد اپنے والد سے نقل فرماتے ہیں کہ وہ مدینہ سے نکلے ، انھوں نے حاطب کے پاس تر درخت پایا جو انھوں نے مدینہ کے درختوں سے کاٹا تھا۔ انھوں نے ان کا سامان لے لیا۔ اس کے بارے میں کلام کی گئی۔ وہ کہنے لگے : میں مال غنیمت نہ چھوڑوں گا جو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے مجھے عطا کیا ہے اگرچہ میں لوگوں میں سے سب سے زیادہ مال والا ہوں۔
(9975) amer bin saad apne walid se naql farmate hain ki woh madina se nikle, unhon ne hatim ke pass tar darakht paya jo unhon ne madina ke darakhton se kata tha. unhon ne un ka saman le liya. is ke bare mein kalam ki gai. woh kahne lage : main mal ghanimat nah chhorun ga jo rasool allah ((صلى الله عليه وآله وسلم)) ne mujhe ata kiya hai agarche main logon mein se sab se zyada maal wala hun.
Sulaiman bin Abdullah said: I saw Sa'd bin Abi Waqqas (RA) apprehending a man who was hunting in the sanctuary of Medina, which the Messenger of Allah (ﷺ) had declared as such. His clothes were taken away. His master came and spoke to him about it, whereupon Sa'd bin Abi Waqqas (RA) said: "This is what the Messenger of Allah (ﷺ) has declared as a sanctuary. You (ﷺ) said: 'Whoever catches someone hunting, he should take his equipment.' I will never return the wealth or food that the Messenger of Allah (ﷺ) has bestowed. But if you wish, I will return its price to you."

(٩٩٧٦) سلیمان بن عبداللہ فرماتے ہیں کہ میں نے سعد بن ابی وقاص (رض) کو دیکھا، انھوں نے ایک آدمی کو پکڑا جو حرم مدینہ میں شکار کر رہا تھا، جس کو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے حرم قرار دیا تھا۔ اس کے کپڑے چھین لیے۔ اس کے آقا آئے، انھوں نے اس کے بارے میں کلام کیا تو سعد بن ابی وقاص (رض) کہنے لگے کہ اس کو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے حرم قرار دیا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے کسی کو شکار کرتے پکڑ لیا وہ اس کا سامان لے لے۔ میں تو وہ مال یا کھانا جو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے عطا کیا ہے ہرگز واپس نہ کروں گا۔ لیکن اگر تم چاہو تو میں اس کی قیمت واپس کردیتا ہوں۔
9976 Sulaiman bin Abdullah farmate hain ke maine Saad bin Abi Waqas (RA) ko dekha, unhon ne aik aadmi ko pakra jo haram Madinah mein shikar kar raha tha, jisko Rasool Allah ((صلى الله عليه وآله وسلم)) ne haram qarar diya tha. Uske kapre chheen liye. Uske aqa aye, unhon ne uske bare mein kalam kiya to Saad bin Abi Waqas (RA) kehne lage ke usko Rasool Allah ((صلى الله عليه وآله وسلم)) ne haram qarar diya, aap ((صلى الله عليه وآله وسلم)) ne farmaya: Jisne kisi ko shikar karte pakar liya wo uska saman le le. Main to wo maal ya khana jo Rasool Allah ((صلى الله عليه وآله وسلم)) ne ata kiya hai hargiz wapas na karoon ga. Lekin agar tum chaho to main uski qeemat wapas karta hun.
