Chapter on one who assigns inheritance to someone who is not his legal heir or a slave in the public treasury
باب من جعل ميراث من لم يدع وارثا ولا مولى في بيت المال
Sunan al-Kubra Bayhaqi 12399
Miqdam Kandi narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said: I am closer to every believer than his own life. Whoever leaves behind a debt or children, they are my responsibility. Whoever leaves behind wealth, it is for his heirs. And whoever has no guardian, I am his guardian. I am the heir of his wealth, and I will free his prisoners. And the (maternal) uncle is the heir of the one who has no other heir. He is the inheritor of his wealth and will free his prisoners.

(١٢٣٩٩) حضرت مقدام کندی فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میں ہر مومن کا اس کی جان سے زیادہ قریبی ہوں، جو قرض یا اولاد چھوڑے وہ ہماری طرف ہے اور جو مال چھوڑے وہ اس کے ورثاء کے لیے ہے اور جس کا کوئی والی نہ ہو میں اس کا والی ہوں۔ میں اس کے مال کا وارث ہوں اور اس کے قیدی چھڑاؤں گا اور ماموں اس کا وارث ہے جس کا کوئی اور وارث نہ ہو، وہ اس کے مال کا وارث ہے اور اس کے قیدیوں کو چھڑائے گا۔
Hazrat Muqdam Kandi farmate hain ke Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya : mein har momin ka uski jaan se zyada qareebi hun, jo qarz ya aulad chhore woh hamari taraf hai aur jo maal chhore woh uske warisa ke liye hai aur jiska koi wali na ho mein uska wali hun. Mein uske maal ka waris hun aur uske qaidichhuraunga aur mamun uska waris hai jiska koi aur waris na ho, woh uske maal ka waris hai aur uske qaidion ko chhuraega.
It was narrated from Aisha (may Allah be pleased with her) that a man entered a garden and died there. He left some possessions but had no children. The Messenger of Allah (peace and blessings of Allah be upon him) said: “Give his inheritance to one of the people of his town.”

(١٢٤٠٠) حضرت عائشہ (رض) سے روایت ہے کہ ایک آدمی باغ میں واقع ہوا، پھر وہ فوت ہوگیا، اس نے کچھ چھوڑا اور کوئی اولاد نہ تھی، رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اس کی میراث اس کی بستی والوں میں سے کسی کو دے دو ۔
hazrat ayesha (rz) se riwayat hai keh aik aadmi bagh mein waqe huwa, phir woh foot hogaya, us ne kuch chora aur koi aulad na thi, rasool allah ((صلى الله عليه وآله وسلم)) ne farmaya : us ki miraas us ki basti walon mein se kisi ko de do .
It was narrated from Aisha that the freed slave of the Messenger of Allah (ﷺ) died. The Prophet (ﷺ) said: "Is there anyone from among the people of his town?" They said: "Yes." The Prophet (ﷺ) gave him his inheritance.

(١٢٤٠١) حضرت عائشہ (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کا مولیٰ فوت ہوگیا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کیا اس کی بستی والوں میں سے کوئی ہے ؟ انھوں نے کہا : ہاں نبی (صلی اللہ علیہ وآلہ وسلم) نے اسے اس کی میراث دے دی۔
Hazrat Ayesha (Razi Allah Anha) se riwayat hai ki Rasul Allah ((صلى الله عليه وآله وسلم)) ka Maula فوت hogaya, Aap ((صلى الله عليه وآله وسلم)) ne farmaya: kya iski basti walon mein se koi hai? Unhon ne kaha: Haan. Nabi ((صلى الله عليه وآله وسلم)) ne use iski miraas de di.
Ibn Buraidah reported on the authority of his father that a person of the tribe of Khuza'ah died in the time of the Prophet (ﷺ). His inheritance was brought to the Prophet (ﷺ). He (the Holy Prophet) said: Look for his inheritor. They searched (for his inheritor) but found none. It was brought to his (Prophet's) notice. He (the Holy Prophet) said: Give it to the chief of Khuza'ah.

(١٢٤٠٢) ابن بریدہ اپنے والد سے نقل فرماتے ہیں کہ خزاعہ کا ایک آدمی نبی (صلی اللہ علیہ وآلہ وسلم) کے زمانہ میں فوت ہوگیا، اس کی میراث نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس لائی گئی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : دیکھو اس کا کوئی وارث ہے ؟ انھوں نے تلاش کیا، لیکن کوئی نہ ملا۔ نبی (صلی اللہ علیہ وآلہ وسلم) کو بتایا گیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : خزاعہ کے بڑے آدمی کو اس کی میراث دے دو ۔
12402 Ibn Buraidah apne walid se naql farmate hain ke Khuzaah ka ek aadmi Nabi ((صلى الله عليه وآله وسلم)) ke zamane mein foot hogaya, uski miraas Nabi ((صلى الله عليه وآله وسلم)) ke paas laayi gayi. Aap ((صلى الله عليه وآله وسلم)) ne farmaya: dekho uska koi waris hai? Unhon ne talaash kiya, lekin koi na mila. Nabi ((صلى الله عليه وآله وسلم)) ko bataya gaya to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Khuzaah ke bade aadmi ko uski miraas de do.
Abdullah bin Buraidah narrated from his father that a man came to the Prophet (peace and blessings of Allah be upon him) and said: I have an inheritance belonging to a man from the tribe of Azd, and I cannot find any Azdi to whom I can give it. The Prophet (peace and blessings of Allah be upon him) said: Go and find a Khuza'i and give it to him. When he left, the Prophet (peace and blessings of Allah be upon him) said: Bring him back to me. When he came, the Prophet (peace and blessings of Allah be upon him) said: Look for an elderly Khuza'i man and give it to him.

(١٢٤٠٣) عبداللہ بن بریدہ اپنے والد سے نقل فرماتے ہیں کہ ایک آدمی نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا : اس نے کہا : میرے پاس ازد قبیلے کے آدمی کی وراثت ہے اور میں کسی ازدی کو نہیں پاتا کہ اس کو دے دوں، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جا کسی خزاعی کو تلاش کر اور اسے دے دے۔ جب وہ چلا گیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اسے میرے پاس لاؤ۔ جب وہ آیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : خزاعہ کے بڑے آدمی کو دیکھو اور اسے دے دو ۔
12403 Abdullah bin Buraidah apne walid se naql farmate hain ke ek aadmi Nabi ((صلى الله عليه وآله وسلم)) ke paas aaya: usne kaha: mere paas Azad qabile ke aadmi ki warasat hai aur mein kisi Azdi ko nahin pata ke usko de dun, aap ((صلى الله عليه وآله وسلم)) ne farmaya: ja kisi Khazaai ko talaash kar aur use de de. Jab wo chala gaya to aap ((صلى الله عليه وآله وسلم)) ne farmaya: use mere paas lao. Jab wo aaya to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Khazaah ke bade aadmi ko dekho aur use de do.
Masroof reported: I went to Abdullah bin Masud (may Allah be pleased with him) and said: "A man came to us, he went to the mountain and passed away. He left three hundred Dirhams." Ibn Masud (may Allah be pleased with him) said: "Does he have any heir or anyone amongst you who takes care of him?" I said: "No." Ibn Masud (may Allah be pleased with him) said: "There are many heirs here, and his wealth should be deposited in Bait-ul-Mal (treasury)."

(١٢٤٠٤) مسروق فرماتے ہیں : میں عبداللہ ابن مسعود (رض) کے پاس گیا، میں نے کہا : ایک آدمی ہم میں آیا تھا، وہ پہاڑ کی طرف گیا اور فوت ہوگیا۔ اس نے تین سو درہم چھوڑے ہیں۔ ابن مسعود (رض) نے کہا : اس کا کوئی وارث ہے یا تم میں سے کوئی اس کی ولاء رکھتا ہو ؟ میں نے کہا : نہیں۔ ابن مسعود (رض) نے کہا : یہاں بہت زیادہ وارث ہیں اور اس کا مال بیت المال میں داخل کردیا۔
Masruq farmate hain : main Abdullah ibn Masud (RA) ke pass gaya, main ne kaha : ek aadmi hum mein aaya tha, woh pahar ki taraf gaya aur faut hogaya. Usne teen sau dirham chhore hain. Ibn Masud (RA) ne kaha : uska koi waris hai ya tum mein se koi uski wilayat rakhta ho ? Main ne kaha : nahin. Ibn Masud (RA) ne kaha : yahan bahut zyada waris hain aur uska maal baitul maal mein dakhil kardiya.
