Sunan al-Kubra Bayhaqi 13677
The Prophet (peace and blessings of Allah be upon him) said: "A previously married woman has more right concerning her marriage than her guardian, and permission is to be sought from a virgin woman, and her silence is [considered as] her permission."

(١٣٦٧٧) نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شادی شدہ اپنے نکاح کی اپنے اولیاء کی نسبت زیادہ حق دار ہے اور کنواری عورت سے اجازت لی جائے گی اور اس کی اجازت خاموشی ہے۔
(13677) Nabi ((صلى الله عليه وآله وسلم)) ne farmaya : Shadi shuda apne nikah ki apne auliya ki nisbat zyada haqdaar hai aur kunwari aurat se ijazat li jayegi aur uski ijazat khamoshi hai.
Ibn 'Abbas narrated that the Prophet (peace and blessings of Allah be upon him) said: "It is not permissible for a guardian to give a previously married woman in marriage without consulting her, but an orphan girl may be consulted and her silence is considered her consent."

(١٣٦٨٠) ابن عباس فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کسی ولی کے لیے یہ جائز نہیں ہے کہ شادی شدہ کا معاملہ خود کرے البتہ یتیم لڑکی سے مشورہ کیا جائے اور اس کی اجازت خاموشی ہے۔
(13680) ibne abbas farmate hain ke nabi ((صلى الله عليه وآله وسلم)) ne farmaya : kisi wali ke liye ye jaiz nahi hai ke shadi shuda ka mamla khud kare albatta yatim ladki se mashwara kiya jaye aur us ki ijazat khamoshi hai.
Sayyida Aisha (RA) narrates that the Prophet (PBUH) said: "Women should be consulted regarding their private parts (meaning where they want to get married)." Aisha (RA) said: "I said, 'O Prophet of Allah! They feel shy.' So, you (PBUH) said: 'The married woman has more right over her soul, and the virgin should be asked, and her silence is her permission.'"

(١٣٦٨١) سیدہ عائشہ (رض) فرماتی ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : عورتوں سے ان کی شرم گاہوں کے بارے میں مشورہ کیا جائے گا (یعنی شادی کہاں کرنی ہے) تو حضرت عائشہ (رض) فرماتی ہیں کہ میں نے کہا : اے اللہ کے نبی ! وہ شرم کرتی ہیں تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شادی شدہ اپنے نفس کی زیادہ حق دار ہے اور کنواری سے پوچھا جائے اور اس کا چپ رہنا اس کی اجازت ہے۔
Seda Ayesha (Raz) farmati hain keh Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Auraton se un ki sharm gaahon ke bare mein mashwara kiya jaye ga (yani shadi kahan karni hai) to Hazrat Ayesha (Raz) farmati hain keh maine kaha: Aye Allah ke Nabi! Woh sharm karti hain to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Shadi shuda apne nafs ki zyada haqdar hai aur kunwari se poocha jaye aur uska chup rehna us ki ijazat hai.
Abu Huraira (may Allah be pleased with him) reported that the Prophet (peace and blessings of Allah be upon him) said: "A previously married woman should not be married until she is consulted, and a virgin should not be married until her permission is sought." It was said: "O Messenger of Allah! How can we know her permission?" He said: "Her silence (is her permission)."

(١٣٦٨٢) ابوہریرہ (رض) فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شادی شدہ کی شادی نہ کی جائے حتیٰ کہ اس سے مشورہ کیا جائے اور کنواری کی شادی نہ کی جائے حتیٰ کہ اس سے اجازت لی جائے۔ کہا گیا : اے اللہ کے نبی ! اس کی اجازت کیسے ہوگی ؟ فرمایا : جب وہ چپ ہوگئی تو اس کی رضا مندی ہے۔
(13682) Abu Hurairah (RA) farmate hain ki Nabi (SAW) ne farmaya: Shadi shuda ki shadi na ki jaye hatta ki us se mashwara kiya jaye aur kunwari ki shadi na ki jaye hatta ki us se ijazat li jaye. Kaha gaya: Aye Allah ke Nabi! Us ki ijazat kaise hogi? Farmaya: Jab woh chup ho gayi to us ki raza mandi hai.
Khawla bint Khuzaimah Ansariyyah (may Allah be pleased with her) was married off by her father, but she disliked the marriage. She came to the Messenger of Allah (peace and blessings of Allah be upon him), and he annulled her marriage.

(١٣٦٨٣) خنساء بنت خزام انصاریہ (رض) کے باپ نے اس کی شادی کردی اور وہ ناپسند کرتی تھی، وہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی تو آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کا نکاح رد کردیا۔
(13683) Khansa bint Khuzaim Ansari (RA) ke baap ne us ki shadi kar di aur wo napasand karti thi, wo Rasul Allah (SAW) ke paas aai to aap (SAW) ne us ka nikah rad kar diya.
Mujamma' bin Yazid and 'Abdur-Rahman bin Yazid reported to Qasim bin Muhammad that a man amongst them, nicknamed Khuzam, gave his daughter in marriage to a man she disliked. She came to the Messenger of Allah (ﷺ) and told him her story. So you (ﷺ) annulled her marriage. She then married 'Ubaydullah bin Munzir.

(١٣٦٨٤) مجمع بن یزید اور عبدالرحمن بن یزید نے قاسم بن محمد کو خبر دی کہ ان میں سے ایک شخص جیسے خذام کہا جاتا تھا نے اپنی بیٹی کا نکاح ایک ایسے شخص سے کردیا جسے وہ ناپسند کرتی تھی وہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور قصہ ذکر کیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کے نکاح کو رد کردیا پھر اس نے ابولبابہ بن منذر سے نکاح کیا۔
Majmaa bin Yazid aur Abdurrahman bin Yazid ne Qasim bin Muhammad ko khabar di keh un mein se aik shakhs jaise Khuzaam kaha jata tha ne apni beti ka nikah aik aise shakhs se kardiya jise wo napasand karti thi wo Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas aai aur qissa zikar kiya to aap ((صلى الله عليه وآله وسلم)) ne uske nikah ko rad kardiya phir usne Abulbaba bin Mundhir se nikah kiya.
Khawla bint Khuzamah's (may Allah be pleased with her) father married her to someone she disliked. She came to the Prophet (peace and blessings of Allah be upon him) and said, "My father has married me into a family I dislike, though I am in control of my own affairs and he didn't even inform me." The Prophet (peace and blessings of Allah be upon him) said: "Then marry whomever you wish." So she married Awf ibn al-Mu'ammar.

(١٣٦٨٦) خنساء بنت خذام (رض) کے باپ نے اس کی شادی اس سے کردی جس کو وہ ناپسند کرتی تھی، وہ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور کہا : میرے باپ نے میری ایسی جگہ پر شادی کی ہے جس کو میں ناپسند کرتی ہوں، حالانکہ میں اپنے نفس کی خود مالک ہوں اور مجھے پتہ بھی نہیں چلا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تو جہاں چاہتی ہے وہاں نکاح کرلے تو اس نے ابولبابہ بن عبدالمنذر سے شادی کرلی۔
Khansa Bint Khidam (Razi Allah Anha) k baap ne us ki shadi us se kardi jis ko wo napasand karti thi, wo Nabi ((صلى الله عليه وآله وسلم)) k pass aai aur kaha: mere baap ne meri aisi jaga par shadi ki hai jis ko main napasand karti hun, halanki main apne nafs ki khud malik hun aur mujhe pata bhi nahi chala, aap ((صلى الله عليه وآله وسلم)) ne farmaya: to jahan chahti hai wahan nikah karle to us ne Abulbaba bin Abdil Munzir se shadi karli.
Narrated Ibn 'Abbas (RA): A woman whose husband had died had a son. The brother of her husband sent a proposal to her father, asking him to marry her to him, but she refused. He married her off against her will, so the woman came to the Prophet (PBUH) and mentioned the entire situation. The Prophet (PBUH) sent for the man and asked him: “Did you marry her to anyone other than the son's paternal uncle?”. He replied: “Yes, I married her to someone better than the son’s paternal uncle.” So the Messenger of Allah (PBUH) separated the couple and married her to the brother of her (deceased) husband.

(١٣٦٨٨) سیدنا ابن عباس (رض) سے روایت ہے کہ ایک عورت کا خاوند فوت ہوگیا، اس کا ایک لڑکا تھا۔ لڑکے کے چچا نے اس عورت سے منگنی کا پیغام اس کے والد کی طرف بھیجا کہ تو اس کی شادی مجھ سے کر دے تو اس نے انکار کردیا، اس نے اس عورت کی شادی اس کی رضا مندی کے بغیر کردی تو وہ عورت نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور سارا واقعہ ذکر کیا، نبی (صلی اللہ علیہ وآلہ وسلم) نے اس کی طرف آدمی بھیجا پھر کہا : کیا تو نے اس کی شادی اس کے بیٹے کے چچا کے علاوہ کسی اور سے کردی۔ اس نے کہا : جی ہاں، میں نے اس کی شادی اس کے بیٹے کے چچا سے بہتر لڑکے سے کردی تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے دونوں میں تفریق کردی اور اس کے بیٹے کے چچا سے اس کی شادی کردی۔
(13688) Syedna Ibn Abbas (RA) se riwayat hai ki ek aurat ka khawand foot ho gaya, us ka ek ladka tha. Ladke ke chacha ne us aurat se mangni ka paigham us ke walid ki taraf bheja ki tu us ki shadi mujh se kar de to us ne inkar kar diya, us ne us aurat ki shadi us ki raza mandi ke baghair kar di to woh aurat Nabi ((صلى الله عليه وآله وسلم)) ke paas aai aur sara waqea zikar kiya, Nabi ((صلى الله عليه وآله وسلم)) ne us ki taraf aadmi bheja phir kaha : kya tune us ki shadi us ke bete ke chacha ke ilawa kisi aur se kar di. Us ne kaha : ji haan, main ne us ki shadi us ke bete ke chacha se behtar ladke se kar di to Rasul Allah ((صلى الله عليه وآله وسلم)) ne donon mein tafreeq kar di aur us ke bete ke chacha se us ki shadi kar di.
Abu Salama reported that a woman came to the Prophet (ﷺ) and said: My father has given me in marriage to a person I dislike, and I want to be married to my husband's brother's son. He (the Holy Prophet) declared her marriage to be invalid.

(١٣٦٨٩) ابو سلمہ کہتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس ایک عورت آئی۔ اس نے کہا : میرے والد نے میری شادی ایسی جگہ پر کی ہے جس کو میں ناپسند کرتی ہوں۔ میں اپنے بیٹے کے چچا سے شادی کرنا چاہتی ہوں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کا نکاح رد کردیا۔
(13689) Abu Salma kehte hain ki Nabi ((صلى الله عليه وآله وسلم)) ke pass ek aurat aai. Usne kaha: Mere walid ne meri shadi aisi jaga par ki hai jisko main napasand karti hun. Main apne bete ke chacha se shadi karna chahti hun. Aap ((صلى الله عليه وآله وسلم)) ne uska nikah rad kardiya.
