It is narrated by Muhammad bin Ash'ath that his Jewish paternal aunt died in Yemen. He mentioned this to Sayyidina Umar bin Al-Khattab, may Allah be pleased with him, who said: “Whoever is their closest relative adhering to their religion will be their heir.” (Meaning you are a Muslim, you will not be the heir of this Jewish aunt, her Jewish relative will be her heir).

محمد بن اشعث سے مروی ہے کہ ان کی یہودیہ پھوپھی یمن میں فوت ہو گئیں، انہوں نے اس کا تذکرہ سیدنا عمر بن الخطاب رضی اللہ عنہ سے کیا تو انہوں نے کہا: جو ان کا قریبی رشتہ دار ان کے مذہب پر ہو گا وہی ان کا وارث ہو گا۔ (یعنی تم مسلمان ہو، اس یہودیہ پھوپھی کے وارث نہ ہو گے، ان کا یہودی رشتے دار ہی ان کا وارث ہو گا۔)
Muhammad bin Ashas se marvi hai ki un ki yahudiya phoophi Yemen mein faut ho gayin, unhon ne is ka tazkira Sayyiduna Umar bin Al-Khattab (رضي الله تعالى عنه) se kiya to unhon ne kaha: Jo un ka qareebi rishta dar un ke mazhab par ho ga wohi un ka waris ho ga. (yani tum musalman ho, is yahudiya phoophi ke waris na ho ge, un ka yahudi rishte dar hi un ka waris ho ga.).
Tariq bin Shihab said: The maternal aunt of Ash'ath bin Qais, who was Jewish, passed away. When he came to Umar bin Al-Khattab, may Allah be pleased with him, he replied: "Those who are upon their religion (meaning, only the Jews) will be their inheritors."

طارق بن شہاب نے کہا: اشعث بن قیس کی پھوپھی وفات پا گئیں جو کہ یہودی تھیں، وہ سیدنا عمر بن الخطاب رضی اللہ عنہ کے پاس آئے تو انہوں نے جواب دیا: جو ان کے دین پر ہیں (یعنی یہودی ہیں صرف) وہی ان کے وارث ہوں گے۔
Tariq bin Shahab ne kaha Ashas bin Qais ki phoophi wafaat pa gain jo keh yahoodi thin woh Sayyiduna Umar bin al-Khattab (رضي الله تعالى عنه) ke paas aaye to unhon ne jawab diya jo in ke deen par hain yani yahoodi hain sirf wohi in ke waris honge.
Ibrahim (may Allah have mercy on him) said: Sayyidina Umar bin Al-Khattab (may Allah be pleased with him) said: We are not heirs of the polytheists, nor will they be heirs of us.
ابراہیم رحمہ اللہ نے کہا: سیدنا عمر بن الخطاب رضی اللہ عنہ نے کہا: ہم مشرکین کے وارث نہیں ہیں، نہ وہ ہمارے وارث ہوں گے۔
Ibrahim rehmatullah alaih ne kaha: Sayyidna Umar bin al-Khattab (رضي الله تعالى عنه) ne kaha: Hum mushrikeen ke waris nahin hain, na woh humare waris honge.
Shu'bi (may Allah have mercy on him) said: "Indeed, the Messenger of Allah (peace and blessings of Allah be upon him) and Abu Bakr and Umar (may Allah be pleased with them) did not consider two people of (different) religions to inherit from each other."

شعبی رحمہ اللہ نے کہا: بیشک رسول اللہ ﷺ اور سیدنا ابوبکر و سیدنا عمر رضی اللہ عنہما دو (مختلف) دین کے لوگوں کو آپس میں وارث نہیں مانتے تھے۔
Shabi rehmatullah alayh ne kaha: beshak Rasul Allah sallallahu alayhi wasallam aur Sayyiduna Abu Bakr wa Sayyiduna Umar ( (رضي الله تعالى عنه) a do (mukhthalif) deen ke logon ko aapas mein waris nahin mante thay.
Amir ash-Sha'bi (may Allah have mercy on him) said: 'Umar (may Allah be pleased with him) said: "Two (different) communities will not inherit from each other."
عامر (الشعبی) رحمہ اللہ نے کہا: سیدنا عمر رضی اللہ عنہ نے فرمایا: دو (مختلف) ملتوں کے لوگ ایک دوسرے کے وارث نہ ہوں گے۔
Aamir (Ash-Sha'bi) Rahimahullah ne kaha: Sayyidna Umar (رضي الله تعالى عنه) ne farmaya: do (mukhtalif) millaton ke log ek doosre ke waris na honge.
Jabir (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) said, "We will not inherit from the People of the Book, nor will they inherit from us, except that a man may inherit from his slave or his slave-girl." (That is, a Muslim will not inherit from a non-Muslim, but if someone's non-Muslim slave or slave-girl dies, then their property will belong to their master).

سیدنا جابر رضی اللہ عنہ نے کہا: رسول اللہ ﷺ نے فرمایا: ”اہل کتاب کے نہ ہم وارث ہوں گے نہ وہ ہمارے وارث ہوں گے۔ سوائے اس کے کہ کسی آدمی کا غلام یا اس کی لونڈی فوت ہو جائے۔“ (یعنی مسلم غیر مسلم کا وارث نہیں لیکن کسی کا غیر مسلم غلام یا لونڈی فوت ہوئے تو اس کا مال آقا کو ملے گا۔)
Sayyidna Jabir (رضي الله تعالى عنه) ne kaha: Rasul Allah (صلى الله عليه وآله وسلم) ne farmaya: ”Ahl e kitab ke na hum waris honge na woh hamare waris honge. Siwaye is ke ke kisi aadmi ka ghulam ya uski laundi foot ho jaye.“ (yani muslim ghair muslim ka waris nahi lekin kisi ka ghair muslim ghulam ya laundi foot huye to uska maal aqa ko milega.)
Masruq (may Allah have mercy on him) said: Sayyiduna Mu'awiya (may Allah be pleased with him) considered a Muslim to be an heir of a disbeliever, but he did not consider a disbeliever to be an heir of a Muslim. Sha'bi (may Allah have mercy on him) said: Masruq said: I did not find any better judgment than this in Islam. Imam Darimi (may Allah have mercy on him) was asked: Do you also say the same? He said: No (meaning inheritance between the two is not permissible, as will be mentioned in the Sahih Hadith later).

مسروق رحمہ اللہ نے کہا: سیدنا معاویہ رضی اللہ عنہ مسلمان کو کافر کا وارث مانتے تھے لیکن کافر کو مسلم کا وارث نہیں مانتے تھے، شعبی رحمہ اللہ نے کہا: مسروق نے کہا: اسلام میں اس سے زیادہ اچھا مجھے اور کوئی فیصلہ نہ لگا۔ امام دارمی رحمہ اللہ سے پوچھا گیا: کیا آپ بھی یہی فرماتے ہیں؟ کہا: نہیں (یعنی دونوں کے درمیان توارث جائز نہیں جیسا کہ آگے صحیح حدیث میں آرہا ہے۔)
Masrooq rehmatullahi alaihe ne kaha: Sayyiduna Muawiya raziAllahu anhu musalman ko kafir ka waris mante thay lekin kafir ko muslim ka waris nahi mante thay, Shabi rehmatullahi alaihe ne kaha: Masrooq ne kaha: Islam mein is se ziada achcha mujhe aur koi faisla na laga. Imam Darmi rehmatullahi alaihe se poocha gaya: kya aap bhi yahi farmate hain? kaha: nahi (yani donon ke darmiyaan toarat jaiz nahi jaisa ke aage sahih hadees mein araha hai).
Amr ibn Shu'aib reported that Mu'adh bint Harith, a Jewish woman of Yemen, died. Al-Ash'ath ibn Qays, whose maternal aunt she was, went to 'Umar ibn al-Khattab and asked him about her inheritance. 'Umar said, "You have no inheritance from her. The people of her religion who are her next of kin will inherit from her. Two different religious communities do not inherit from each other."

عامر الشعبی رحمہ اللہ نے کہا: معزلہ بنت حارث یہودیہ یمن میں فوت ہوئیں تو اشعث بن قیس جن کی وہ پھوپھی تھیں سوار ہو کر اس کی میراث کے بارے میں پوچھنے سیدنا عمر رضی اللہ عنہ کے پاس آئے، سیدنا عمر رضی اللہ عنہ نے فرمایا: تم ان کی میراث نہیں پا سکتے ہو، ان کے دین والا ان کا قریبی رشتے دار ہی ان کا وارث ہو گا (کیوں کہ) دو ملتوں کے لوگ آپس میں ایک دوسرے کے وارث نہیں بنتے۔
Aamir Al-Shaabi (RA) ne kaha: Muzila bint Haris Yahudiya Yemen mein faut हुईं to Ashas bin Qais jin ki woh phuppi thi sawar ho kar us ki miraas ke bare mein puchne Sayyiduna Umar (RA) ke paas aaye, Sayyiduna Umar (RA) ne farmaya: Tum un ki miraas nahi paa sakte ho, un ke deen wala un ka qareebi rishte dar hi un ka waris ho ga (kyunki) do millaton ke log aapas mein ek dusre ke waris nahi bante.
Anas bin Sirin said: Sayyiduna Umar (may Allah be pleased with him) said: Two people from two different religions will not inherit from each other, and whoever does not inherit will not be deprived.
انس بن سیرین نے کہا: سیدنا عمر رضی اللہ عنہ نے فرمایا: دو مختلف ملتوں کے لوگ وارث نہ ہوں گے، اور جو وارث نہ ہو محروم بھی نہ کرے گا۔
Anas bin Sireen ne kaha: Sayyidna Umar (رضي الله تعالى عنه) ne farmaya: do mukhtalif millaton ke log waris na honge, aur jo waris na ho mehroom bhi na karega.
It is narrated on the authority of Sayyiduna Usama bin Zaid (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "A Muslim cannot be an heir of a disbeliever, nor can a disbeliever be an heir of a Muslim."

سیدنا اسامہ بن زید رضی اللہ عنہ سے مروی ہے کہ رسول اللہ ﷺ نے فرمایا: ”مسلمان کافر کا وارث نہیں ہو سکتا اور نہ کافر مسلمان کا وارث ہو سکتا ہے۔“
Sayyidna Usama bin Zaid (رضي الله تعالى عنه) se marvi hai ki Rasul Allah (صلى الله عليه وآله وسلم) ne farmaya: "Musalman kafir ka waris nahi ho sakta aur na kafir musalman ka waris ho sakta hai."
Ibrahim (peace be upon him) said: When a man dies, the right (inheritance) of the heir becomes obligatory, and he left nothing from the inheritance for the one who becomes Muslim or is freed before the division of inheritance.

ابراہیم رحمہ اللہ نے کہا: جب آدمی مر جائے تو وارث کا حق (وراثت) واجب ہو جاتا ہے، اور جو میراث کی تقسیم سے پہلے مسلمان ہو یا آزاد ہو اس کے لئے میراث میں سے انہوں نے کچھ نہیں رکھا۔
Ibraheem rehmatullah alaih ne kaha: Jab aadmi mar jaye to waris ka haq (wirath) wajib ho jata hai, aur jo miras ki taqseem se pehle musalman ho ya azad ho uske liye miras mein se unhon ne kuch nahi rakha.
Our master Usama bin Zaid, may Allah be pleased with him, said: The Messenger of Allah, peace and blessings be upon him, said: “A Muslim is not an heir of a disbeliever, nor is a disbeliever an heir of a Muslim.”

سیدنا اسامہ بن زید رضی اللہ عنہ نے کہا: رسول اللہ ﷺ نے فرمایا: ”مسلمان کافر کا وارث نہیں ہو سکتا ہے اور نہ کافر مسلمان کا وارث ہو سکتا ہے۔“
Saidna Usama bin Zaid (رضي الله تعالى عنه) ne kaha: Rasul Allah (صلى الله عليه وآله وسلم) ne farmaya: ”Musalman kafir ka waris nahi ho sakta hai aur na kafir musalman ka waris ho sakta hai.“
