It is narrated on the authority of Shabi that Sayyidna Umar, Sayyidna Ali, Sayyidna Zaid and I think Sayyidna Abdullah bin Masood (may Allah be pleased with them all) said: "The right of inheritance (wila) is for the eldest." And by "eldest," they meant the one closest in relation to the father and mother.

شعبی رحمہ اللہ سے مروی ہے کہ سیدنا عمر، سیدنا علی، سیدنا زید اور میرا خیال ہے سیدنا عبداللہ بن مسعود رضی اللہ عنہم سب نے کہا: ولاء (حق وراثت) بڑے کے لئے ہے اور وہ بڑے سے مراد اس کو لیتے تھے جو باپ اور ماں کے سب سے زیادہ قریب ہو۔
Shabi rehmatullah alaih se marvi hai keh Sayyidna Umar, Sayyidna Ali, Sayyidna Zaid aur mera khayal hai Sayyidna Abdullah bin Masood razi Allah tala anhum sab ne kaha: Wila (haq wirasat) bade ke liye hai aur wo bade se murad is ko lete the jo baap aur maan ke sab se zyada qareeb ho.
Ubaidullah ibn Utbah reported: Umar ibn al-Khattab, may Allah be pleased with him, wrote to me concerning Fakihah bint Sam'an who had died and left behind a son of a full brother and a son of a paternal brother. Umar, may Allah be pleased with him, wrote that the right of inheritance belongs to the elder (i.e., the son of the full brother).

عبید الله بن عتبہ نے کہا: سیدنا عمر رضی اللہ عنہ نے مجھے فکیہہ بنت سمعان کے بارے میں تحریر فرمایا جو انتقال کر گئی تھی اور حقیقی بھائی کا بیٹا اور ایک بیٹا پدری بھائی کا چھوڑا تھا، سیدنا عمر رضی اللہ عنہ نے لکھا کہ میراث کا حق بڑے (یعنی حقیقی بھائی کے بیٹے) کا ہے۔
Ubaidullah bin Utba ne kaha: Sayyiduna Umar (رضي الله تعالى عنه) ne mujhe Faqeeha bint Saman ke bare mein tahreer farmaya jo inteqal kar gayi thi aur haqeeqi bhai ka beta aur ek beta padri bhai ka chhora tha, Sayyiduna Umar (رضي الله تعالى عنه) ne likha ke miras ka haq bade (yani haqeeqi bhai ke bete) ka hai.
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Ali and Sayyiduna Zayd (may Allah be pleased with them both) said: "The inheritance (wala') belongs to the elder." And Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) and (Judge) Shuraih said: "It will belong to the heirs."

شعبی رحمہ اللہ سے مروی ہے کہ سیدنا علی اور سیدنا زید رضی اللہ عنہما دونوں نے کہا: ولاء بڑے کے لئے ہے، اور سیدنا عبداللہ بن مسعود رضی اللہ عنہ اور (قاضی) شریح نے کہا: وارثین کے لئے ہو گا۔
Shabi rehmatullah alaihe se marvi hai keh syedna Ali aur syedna Zaid razi Allah tala anhuma donon ne kaha: Wila barey ke liye hai, aur syedna Abdullah bin Masood razi Allah tala anhu aur (Qazi) Shariah ne kaha: Warison ke liye hoga.
Shabi (may Allah have mercy on him) said: Sayyiduna Umar, Sayyiduna Abdullah, Sayyiduna Ali and Sayyiduna Zayd (may Allah be pleased with them) determined the wilayah (authority/leadership) to be for the eldest (heir).

شعبی رحمہ اللہ نے کہا: سیدنا عمر، سیدنا عبداللہ، سیدنا علی اور سیدنا زید رضی اللہ عنہم نے ولاء کا فیصلہ بڑے (وارث) کے لئے کیا۔
Shabi rehmatullah alaih ne kaha: Sayyidna Umar, Sayyidna Abdullah, Sayyidna Ali aur Sayyidna Zaid (رضي الله تعالى عنه) ne wilaya ka faisla bade (waris) ke liye kiya.
Ibn Sirin (may Allah have mercy on him) said: Fakih bint Sim'an died and left behind a paternal uncle's son and a real brother's grandson. So, Sayyiduna Umar (may Allah be pleased with him) made the sons of the paternal uncle heirs (because the grandson is a further heir).

ابن سیرین رحمہ اللہ نے کہا: فکیہہ بنت سمعان فوت ہوئیں اور پدری بھائی کا بیٹا اور حقیقی بھائی کا پوتا چھوڑ گئیں تو سیدنا عمر رضی اللہ عنہ نے پدری بھائی کے بیٹوں کو وارث قرار دیا (کیوں کہ پوتے ولی ابعد ہیں)۔
Ibn Sireen rehmatullah alaih ne kaha: Faqeeha bint Samaan فوت ہوئیں aur padri bhai ka beta aur haqeeqi bhai ka pota chhor gayi to Sayyiduna Umar (رضي الله تعالى عنه) ne padri bhai ke beton ko waris qarar diya (kyun k potay wali abed hain).
It is narrated from Ibrahim Nakha'i (may Allah have mercy on him): Sayyiduna Umar, Sayyiduna Ali, Sayyiduna Zayd (may Allah be pleased with them) all said: "Wilaayah (the right of inheritance) is for the elder."

ابراہیم نخعی رحمہ اللہ سے مروی ہے: سیدنا عمر، سیدنا علی، سیدنا زید رضی اللہ عنہم سب نے کہا: ولاء (حق وراثت) بڑے کے لئے ہے۔
Ibrahim Nakha'i rehmatullah alaih se marvi hai: Sayyiduna Umar, Sayyiduna Ali, Sayyiduna Zaid razi Allah anhum sab ne kaha: Wila (haqq warasat) bade ke liye hai.
It is narrated from Mughirah that Ibrahim (may Allah have mercy on him) said regarding two brothers who inherited a slave, whom their father had freed: One of the two brothers died and left behind a son. Ibrahim (may Allah have mercy on him) said: Sayyiduna Ali, Sayyiduna Zaid, Sayyiduna Abdullah (may Allah be pleased with them) used to say: The Wala' (right of inheritance in this case) is for the elder, meaning for the brother; there is nothing for the son of the brother.

مغیرہ سے مروی ہے ابراہیم رحمہ اللہ نے دو بھائیوں کے بارے میں کہا جو غلام کے وارث ہوئے، جس کو ان کے والد نے آزاد کر دیا تھا، ان دو بھائیوں میں سے ایک مر گیا اور اس نے اپنا لڑکا چھوڑا، ابراہیم رحمہ اللہ نے کہا: سیدنا علی، سیدنا زید، سیدنا عبداللہ رضی اللہ عنہم کہتے تھے: ولاء بڑے کے لئے ہے، یعنی بھائی کے لئے ہے، بھائی کی اولاد کے لئے کچھ نہیں۔
Mugheera se marvi hai Ibrahim rehmatullah alaih ne do bhaiyon ke bare mein kaha jo gulaam ke waris huye, jis ko un ke walid ne aazaad kar diya tha, un do bhaiyon mein se ek mar gaya aur usne apna ladka chhoda, Ibrahim rehmatullah alaih ne kaha: Sayyiduna Ali, Sayyiduna Zaid, Sayyiduna Abdullah (رضي الله تعالى عنه) kahte the: Wila bada ke liye hai, yani bhai ke liye hai, bhai ki aulad ke liye kuch nahin.
