Chapter: One who manumits a partner in a slave he co-owns while he is well-off
باب: من أعتق شركا له في عبد وهو موسر.

Ibn Umar (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: “Whoever sets free his share from a slave, and he (the owner) possesses enough wealth to cover the price of the slave, then the price of the slave should be estimated and the rest of the partners given their shares, and the slave should be set free. Otherwise, he will be set free to the extent of the share (that his master has emancipated).

(٢١٣٢٢) ابن عمر (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے غلام سے اپنا حصہ آزاد کردیا اور غلام کی قیمت جتنا مال اس کے پاس موجود ہے تو غلام کی قیمت مقرر کی جائے اور باقی حصہ داروں کو ان کے حصص دیے جائیں اور غلام آزاد ہوجائے۔ وگرنہ اتنا ہی آزاد ہوگا جتنا اس نے آزاد کردیا ہے۔
Ibne Umar (RA) farmate hain ke Rasool Allah (SAW) ne farmaya: Jis ne ghulam se apna hissa azad kar diya aur ghulam ki qeemat jitna maal us ke paas mojood hai to ghulam ki qeemat muqarrar ki jaye aur baqi hissadaron ko un ke hissay diye jayen aur ghulam azad ho jaye. Warna itna hi azad hoga jitna us ne azad kar diya hai.
Abdullah bin Umar (may Allah be pleased with him) narrated that I heard Allah's Messenger (peace and blessings of Allah be upon him) saying, "If a slave has many partners and one of them sets his share free, an assessment will be made of the price of the slave's share from the property of (the slave). If he has enough wealth, he will be set free."

(٢١٣٢٣) عبداللہ بن عمر (رض) فرماتے ہیں کہ میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے سنا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو غلام مختلف آدمیوں کا ہو ایک اپنا حصہ آزاد کر دے تو اس کے مال سے باقی حصص کی قیمت لگائی جائے گی۔ اگر اس کا مال اس کی قیمت کو پورا کرے تو اس کو آزاد کردیا جائے گا۔
(21323) Abdullah bin Umar (RA) farmate hain ke maine Rasul Allah (SAW) se suna, aap (SAW) ne farmaya: Jo gulam mukhtalif admiyon ka ho ek apna hissa azad kar de to uske mal se baqi hisson ki qeemat lagai jayegi. Agar uska mal uski qeemat ko poora kare to usko azad kar diya jayega.
Ibn Umar (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) said, "Whoever frees his share of a slave, then the rest of his price will be valued from his wealth and given to his partner, and the slave will be set free."

(٢١٣٢٤) ابن عمر (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے غلام کا اپنا حصہ آزاد کردیا تو اس کے مال سے غلام کی باقی ماندہ قیمت لگائی جائے گی۔ اس کے شریک کو ادا کی جائے گی اور غلام کو آزاد کردیا جائے گا۔
(21324) ibne umar (rz) farmate hain ke rasool allah ((صلى الله عليه وآله وسلم)) ne farmaya : jis ne ghulam ka apna hissa azad kardiya to uske maal se ghulam ki baqi mandah qeemat lagai jayegi. uske sharik ko ada ki jayegi aur ghulam ko azad kardiya jayega.
Narrated Ibn `Umar (RA): The Messenger of Allah (ﷺ) said: "Whoever frees his share of a slave, then his share should be estimated (and paid by the other partners) and the slave should be freed."

(٢١٣٢٥) ابن عمر (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے غلام کا اپنا حصہ آزاد کردیا، اس غلام کی مناسبقیمت مقرر کی جائے گی، باقی شرکاء کو ان کے حصص دے دیے جائے گے اور غلام آزاد ہوجائے گا۔
(21325) Ibn Umar (RA) Nabi (SAW) se naqal farmate hain keh Rasul Allah (SAW) ne farmaya: Jis ne ghulam ka apna hissa azad kar diya, us ghulam ki munasib qeemat muqarrar ki jaye gi, baqi shuraka ko un ke hisse de diye jayenge aur ghulam azad ho jaye ga.
Ibn Umar (may Allah be pleased with him) used to give this verdict regarding a slave, male or female, who was jointly owned: If one of the partners freed his share and the slave had some wealth, then the rest of the slave should also be freed. A fair price should be estimated, and the remaining partners should be paid the price of their shares, and the slave should be set free. Ibn Umar (may Allah be pleased with him) narrated this as a tradition (hadith) going back to the Prophet (peace and blessings of Allah be upon him).

(٢١٣٢٦) ابن عمر (رض) غلام یا لونڈی کے بارے میں فتویٰ دیتے تھے۔ جو مختلف شرکاء کے درمیان ہو۔ ایک نے اپنا حصہ آزاد کردیا، اگر اس کے پاس مال ہو تو باقی ماندہ غلام کو بھی آزاد کیا جائے گا۔ عادلانہ قیمت لگائی جائے اور باقی شرکاء کو ان کے حصص کے مطابق رقم ادا کردی جائے اور غلام کا راستہ خالی کردیا جائے۔ ابن عمر (رض) یہ حدیث نبی (صلی اللہ علیہ وآلہ وسلم) سے مرفوعنقل فرماتے ہیں۔
21326 Ibn Umar (RA) gulam ya laundi ke bare mein fatwa dete thay jo mukhtalif shuraka ke darmiyaan ho ek ne apna hissa azad kardiya agar uske pass maal ho to baqi mandah gulam ko bhi azad kiya jayega adilane qeemat lagai jaye aur baqi shuraka ko unke hisson ke mutabiq raqam ada kardi jaye aur gulam ka rasta khali kardiya jaye Ibn Umar (RA) yeh hadees Nabi ((صلى الله عليه وآله وسلم)) se marfoo unقل farmate hain
Ibn Umar (may Allah be pleased with him) reported that the Prophet (peace and blessings of Allah be upon him) said: “Whoever sets free his share of a slave, and possesses enough wealth, then he is responsible for paying the price of his partner’s share.”

(٢١٣٢٧) ابن عمر (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سے نقل فرماتے ہیں کہ جس نے غلام کا اپنا حصہ آزاد کردیا اور اس کے پاس غلام کی قیمت موجود ہو تو وہ اپنے ساتھی کی قیمت کا ذمہ دار ہوگا۔
(21327) Ibne Umar (RA) Nabi ((صلى الله عليه وآله وسلم)) se naqal farmate hain ke jisne gulaam ka apna hissa aazad kardiya aur uske paas gulaam ki qeemat mojood ho to woh apne saathi ki qeemat ka zimmedar hoga.
(21328) Salim bin Abdullah narrates from his father that the Messenger of Allah (peace and blessings of Allah be upon him) said: "If a slave has two owners and one of them sets him free, then if he (the slave) is wealthy, a high price or a fair price will be set, without any increase or decrease. Then lots will be drawn for the remaining share."
(B) Imam Shafi'i (may Allah have mercy on him) said that a high price will be set and he will be freed. However, there should be no increase or decrease in the price.

(٢١٣٢٨) سالم بن عبداللہ اپنے والد سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو دو بندوں کا غلام تھا، ایک نے اپنا حصہ آزاد کردیا، اگر وہ مال دار ہے تو مہنگی قیمت یا عدل والی قیمت مقرر کی جائے گی، اس میں کمی بیشی نہ کی جائے گی۔ پھر اس پر باقی حصص کی چٹی ڈالی جائے گی۔
(ب) امام شافعی (رح) نے فرمایا کہ مہنگی قیمت مقرر ہوگی اور آزاد کیا جائے گا۔ لیکن قیمت کے اندر کمی، بیشی نہ کی جائے گی۔
21328 Salem bin Abdullah apne walid se naqal farmate hain ke Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jo do bandon ka ghulam tha, aik ne apna hissa azad kar diya, agar woh maldar hai to mehngi qeemat ya adl wali qeemat muqarrar ki jaye gi, is mein kami beshi na ki jaye gi. Phir is par baqi hisson ki chitti dali jaye gi. (b) Imam Shafi (rh) ne farmaya ke mehngi qeemat muqarrar hogi aur azad kiya jaye ga. Lekin qeemat ke andar kami, beshi na ki jaye gi.
Salem narrated from his father, from his grandfather who said: The Prophet (ﷺ) said: "He who sets free his share of a slave, then an equitable price for him should be determined from his wealth; neither more nor less should be taken. And if he has no wealth, then he is free (from any obligation)."

(٢١٣٣٠) سالم اپنے والد سینقل فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے اپنے حصے کا غلام آزاد کردیا۔ اس کے مال میں عدل کی قیمت مقرر کی جائے گی، کمی بیشی نہ کی جائے گی۔ اگر وہ مال دار ہے تو غلام کی آزادی اس کے ذمہ ہے۔
(21330) Salim apne walid say نقل farmate hain keh Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Jis ne apne hisse ka ghulam azad kar diya us ke maal mein adl ki qeemat muqarrar ki jaye gi kami beshi na ki jaye gi agar woh maal daar hai to ghulam ki azadi us ke zimme hai.
Ibn Umar (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings of Allah be upon him) said, "Whoever frees a slave, and he has enough wealth to cover the price of the slave, then the freeing of the slave is incumbent upon him."

(٢١٣٣١) ابن عمر (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سینقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے غلام آزاد کردیا اور اس کے پاس اتنا مال ہو جو غلام کی قیمت کو پہنچ جائے تو غلام کی آزادی اس کے ذمہ ہے۔
21331 Ibn Umar (RA) Nabi (SAW) se naqal karte hain ki Rasul Allah (SAW) ne farmaya: Jis ne ghulam azad kar diya aur uske paas itna maal ho jo ghulam ki qeemat ko pahunch jaye to ghulam ki aazadi uske zimme hai.
(21332) Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (peace and blessings of Allah be upon him) said: When a man sets free his share from a slave, then the slave becomes free.
(b) In the narration of Tayalsi, it is stated that he will be freed by his wealth.

(٢١٣٣٢) حضرت ابوہریرہ (رض) فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس وقت آدمی اپنا حصہ غلام سے آزاد کر دے تو غلام آزاد ہوجائے گا۔
(ب) طیالسی کی روایت میں ہے کہ وہ اس کے مال سے آزاد ہوگا۔
(21332) Hazrat Abu Huraira (RA) farmate hain keh Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Jis waqt aadmi apna hissa ghulam se azad kar de to ghulam azad ho jaye ga.
(b) Tiyalsi ki riwayat mein hai keh woh uske maal se azad hoga.
Abu Huraira (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) said, "Whoever frees his share of a slave, then if he has enough wealth, the rest of the slave should also be freed."

(٢١٣٣٣) حضرت ابوہریرہ (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے غلام سے اپنا حصہ آزاد کردیا، اگر اس کے پاس مال ہو تو باقی غلام بھی آزاد کیا جائے گا۔
Hazrat Abu Huraira (RA) farmate hain keh Rasul Allah (SAW) ne farmaya: Jis ne ghulam se apna hissa azad kar diya, agar us ke pas maal ho to baqi ghulam bhi azad kiya jaye ga.
Abu Hurairah (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings be upon him) said: "Whoever frees his share of a slave, then it is obligatory upon him to free the rest of the slave if he has the means, for Allah has no partner."

(٢١٣٣٤) حضرت ابوہریرہ (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے غلام سے اپنا حصہ آزاد کر دیاتو باقی غلام کو آزاد کرنا اس کے ذمہ ہے، اگر اس کے پاس مال ہوا۔ کیونکہ اللہ کا کوئی شریک نہیں ہے۔

Abu Huraira (may Allah be pleased with him) reported that a man freed his share of a slave, so the Prophet (peace and blessings of Allah be upon him) declared it lawful and waived the remaining price from him.

(٢١٣٣٥) حضرت ابوہریرہ (رض) فرماتے ہیں کہ ایک آدمی نے اپنا حصہ غلام سے آزاد کردیا تو نبی (صلی اللہ علیہ وآلہ وسلم) نے اس کی آزادی کو جائز قرار دیا اور باقی قیمت کی اس کے ذمہ چٹی ڈالی۔
21335 hazrat abu huraira (rz) farmate hain keh aik aadmi ne apna hissa ghulam se aazaad kardia to nabi ((صلى الله عليه وآله وسلم)) ne uski aazadi ko jaiz qarar diya aur baqi qeemat ki uske zimme chitti dali.
Jabir bin Abdullah (may Allah be pleased with him) narrated that the Prophet (peace and blessings of Allah be upon him and his family) said: "Whoever frees his share of a slave and is able to pay the rest of the price, then the slave is free. The shares of the other partners will be imposed on him (the one who freed his share), and there will be nothing on the slave."

(٢١٣٣٦) جابر بن عبداللہ (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سے نقل فرماتے ہیں کہ جس نے غلام کو آزاد کیا جتنا اس کا حصہ تھا۔ باقی قیمت بھی پوری کرسکتا ہے تو وہ آزاد ہے۔ اس بندے پر باقی شرکاء کے حصص ڈال دیے جائیں گے اور غلام کے ذمہ کچھ بھی نہ ہوگا۔
21336 Jaber bin Abdullah (RA) Nabi (SAW) se naqal farmate hain ke jis ne ghulam ko azad kiya jitna is ka hissa tha baqi qeemat bhi poori kar sakta hai to woh azad hai is bande par baqi shurkaa ke hissay daal diye jayenge aur ghulam ke zimma kuchh bhi nah hoga
Abu Majlaz narrated that two men jointly owned a slave. One of them freed his share (of the slave). The Prophet (peace and blessings of Allah be upon him) kept him (the slave) until he (the slave) sold his share of the spoils of war (and paid the price to his master).

(٢١٣٣٧) ابو مجلز فرماتے ہیں کہ دو آدمیوں کا غلام تھا، ایک نے اپنا حصہ آزاد کردیا، نبی (صلی اللہ علیہ وآلہ وسلم) نے اس کے روکے رکھا یہاں تک کہ اس نے اپنا غنیمت کا حصہ فروخت کردیا۔
21337 abu majlaz farmate hain ke do admiyon ka ghulam tha, ek ne apna hissa azad kardiya, nabi ((صلى الله عليه وآله وسلم)) ne uske roke rakha yahan tak ke usne apna ghanimat ka hissa farokht kardiya.
Muhammad said: There was a slave owned by two men. One man freed his share. The other partner came to 'Umar (may Allah be pleased with him) and he wrote that he (the partner) should assess him (the slave) with a high price.

(٢١٣٣٨) محمد فرماتے ہیں کہ دو آدمیوں کا غلام تھا، ایک نے اپنا حصہ آزاد کردیا، اس کا شریک حضرت عمر (رض) کے پاس آیا، انھوں نے لکھا کہ وہ اس کی مہنگی قیمت مقرر کرے۔
21338 mohammad farmate hain ke do aadmiyon ka ghulam tha, ek ne apna hissa aazaad kardiya, is ka sharik hazrat umar (raz) ke paas aaya, unhon ne likha ke woh is ki mehngi qeemat muqarrar kare.
Shabi says that there was a slave who belonged to two partners. One of them freed his share. It was said that on the day of freeing (the other half), the price will be estimated with justice (and the remaining amount will have to be paid to the other partner).

(٢١٣٣٩) شعبی فرماتے ہیں کہ غلام جو دوبندوں کا تھا، ایک نے اپنا حصہ آزاد کردیا، فرمایا : آزادی کے دن اس کے اوپر عدل والی قیمت مقرر کی جائے گی۔
(21339) shubi farmate hain ke ghulam jo do bandon ka tha, aik ne apna hissa azad kardiya, farmaya : azadi ke din is ke upar adl wali qeemat muqarar ki jayegi.
