Chapter: Regarding claim and denial (dispute over inheritance).

Sunan al-Darimi 3096
It is narrated on the authority of Hasan (may Allah have mercy on him) that a man at the time of his death confessed that so-and-so had a thousand dirhams with him. Another man proved by evidence (bayyinah) that he too had a thousand dirhams with the deceased, and the deceased had left only one thousand dirhams. Hasan (may Allah have mercy on him) said: The property should be distributed equally between both of them unless the deceased was insolvent, in which case his statement should not be accepted.

حسن رحمہ اللہ سے مروی ہے کہ ایک آدمی نے اپنی موت کے وقت اعتراف کیا کہ فلاں آدمی کے اس کے پاس ہزار درہم ہیں، دوسرے آدمی نے بینہ (دلیل) سے ثابت کیا کہ اس کے بھی ہزار درہم ہیں، اور مرنے والے نے صرف ہزار درہم چھوڑے ہیں؟ حسن رحمہ اللہ نے کہا: آدھا آدھا مال دونوں کے درمیان تقسیم کر دیا جائے الا یہ کہ مرنے والا مفلس ہو ایسی صورت میں اس کی بات ماننا جائز نہ ہو گا۔
Hasan rehmatullah se marvi hai ke aik aadmi ne apni maut ke waqt eitraaf kya ke falan aadmi ke uske pass hazaar dirham hain, dusre aadmi ne beina (daleel) se sabit kya ke uske bhi hazaar dirham hain, aur marne wale ne sirf hazaar dirham chhore hain? Hasan rehmatullah ne kaha: aadha aadha maal donon ke darmiyaan taqseem kar diya jaye ila yeh ke marne wala muflis ho aisi soorat mein uski baat manna jaiz na ho ga.
Abu Nu'aym said: I asked my associate: What have you heard regarding two brothers, one of whom claims he is the (deceased's) brother? He said: He will receive the brother's share. I asked: Who mentioned this? He replied: Jabir from Amir, and they from Sayyiduna Ali, may Allah be pleased with him.

ابونعیم نے کہا: میں نے شریک سے پوچھا: دو بھائیوں کے بارے میں آپ نے کیا ذکر کیا ہے جن میں سے ایک دعویٰ کرتا ہے کہ وہ (میت کا) بھائی ہے؟ انہوں نے کہا: وہ بھائی کا حصہ پائے گا، میں نے عرض کیا: یہ کس نے ذکر کیا ہے؟ جواب دیا کہ جابر نے عامر سے اور انہوں نے سیدنا علی رضی اللہ عنہ سے۔
Abu Naeem ne kaha: main ne Shareek se poocha: do bhaiyon ke bare mein aap ne kya zikar kya hai jin mein se ek daawa karta hai ki woh (mayit ka) bhai hai? Unhon ne kaha: woh bhai ka hissa paye ga, main ne arz kiya: yeh kis ne zikar kya hai? Jawab diya ki Jabir ne Aamir se aur unhon ne Sayyiduna Ali (رضي الله تعالى عنه) se.
A'mash (Sulaiman bin Mihran) reported: Narrated from Ibrahim (may Allah have mercy on him): If one of (two) brothers claims brotherhood (of the other) and the other denies it, Ibrahim (may Allah have mercy on him) said: He would join the brothers in the position of a slave, he would give a share for the emancipation of one of them. And 'Amr, Hakam and their companions said: The brother who acknowledges (the relationship) will take that share from his share.
اعمش (سلیمان بن مہران) نے روایت کیا، ابراہیم رحمہ اللہ سے مروی ہے: بھائیوں میں سے بعض (کسی کے) بھائی ہونے کا دعویٰ کرے اور دوسرے اس کا انکار کریں، ابراہیم رحمہ اللہ نے کہا: وہ بھائیوں کے ساتھ غلام کی حیثیت سے شامل ہو گا، ان میں سے ایک آزاد کرانے کا حصہ دے گا۔ اور عامر و حکم اور ان کے شاگردوں نے کہا: جس بھائی نے اعتراف کیا اسی کے حصے سے وہ حصہ لے گا۔
Aamesh (Sulaiman bin Mehran) ne riwayat kiya, Ibrahim rehmatullahi alaih se marvi hai: Bhaiyon mein se baaz (kisi ke) bhai hone ka daawa kare aur dusre iska inkar karen, Ibrahim rehmatullahi alaih ne kaha: Woh bhaiyon ke sath ghulam ki haisiyat se shamil ho ga, un mein se ek azad karane ka hissa de ga. Aur Aamir o Hukm aur unke shagirdon ne kaha: Jis bhai ne ietaraf kiya usi ke hisse se woh hissa le ga.
Wakee' said: Two brothers, one of them claims brotherhood (to a third) and the other denies it. He (Wakee') said: Ibn Abi Layla used to say: The matter will be divided into six parts. The one who denied (the brotherhood) will take three parts, the one who claimed (brotherhood) will take two parts and the one whose brotherhood was claimed will take one part.

وکیع رحمہ اللہ نے کہا: دو بھائیوں میں سے ایک (تیسرے کے) بھائی ہونے کا دعویٰ کرے اور دوسرا انکار کرے، انہوں نے کہا: ابن ابی لیلیٰ کہتے تھے: مسئلہ چھ سے ہو گا، جس نے انکار کیا تین حصے لے گا، دو حصے دعویٰ کرنے والا لے گا اور ایک حصہ وہ لے گا جس کے بھائی ہونے کا دعویٰ کیا۔
Waqay rehmatullah ne kaha do bhaiyon mein se ek teesre ke bhai hone ka daawa kare aur dusra inkar kare unhon ne kaha Ibn e Abi Laila kehte thay masla chhe se hoga jis ne inkar kiya teen hisse le ga do hisse daawa karne wala le ga aur ek hissa woh le ga jis ke bhai hone ka daawa kiya.
Narrated Hammad: A man had three sons. He said, "One-third of my property is for my youngest son." The middle son said, "I agree to that." But the eldest son refused. Hammad said, "The problem should be solved according to the principle of nine." (That is, there will be three shares (of the youngest son) plus the share of the one who agreed). Hammad added, "The rest should be distributed equally among all." Shu'ba said, "The one who refused (to give up his share), (in fact) gave up his (own) share.

حماد سے مروی ہے: آدمی کے تین بیٹے ہیں، اس نے کہا: میرا ایک ثلث (تہائی) مال سب سے چھوٹے بیٹے کے لئے ہے، بیچ والے لڑکے نے کہا: میری طرف سے اجازت ہے، اور بڑے بیٹے نے کہا: میں نہیں مانتا؟ حماد نے کہا: مسئلہ نو سے ہو گا، اس میں تین (سب سے چھوٹے لڑکے ہوں گے) اس کا حصہ اور جس نے اجازت دی اس کا حصہ ہے۔ اور حماد نے کہا: جو باقی بچا وه سب پر برابر لوٹا دیا جائے گا، اور شعبی رحمہ اللہ نے کہا: جس نے رد کر دیا (گویا) اس نے اپنے سے (اپنا حصہ) رد کر دیا۔
Hammad se marvi hai: aadmi ke teen bete hain, usne kaha: mera ek suls (tehai) maal sab se chhote bete ke liye hai, beech wale ladke ne kaha: meri taraf se ijazat hai, aur bade bete ne kaha: main nahin manta? Hammad ne kaha: masla nau se ho ga, is mein teen (sab se chhote ladke hon ge) is ka hissa aur jisne ijazat di us ka hissa hai. Aur Hammad ne kaha: jo baqi bacha woh sab par barabar luta diya jaye ga, aur Shubi rahimahullah ne kaha: jisne rad kar diya (goya) usne apne se (apna hissa) rad kar diya.
Qazi Shuraih said: A man acknowledged (another) as his brother. He (the Qazi) said: He (the man) will have to bring proof that he (the other man) is his brother.

قاضی شریح نے کہا: ایک آدمی نے (دوسرے کے) بھائی ہونے کا اقرار کیا، انہوں نے کہا: اس کو دلیل لانی ہو گی کہ وہ اس کا بھائی ہے۔
Qazi Shuraih ne kaha: Ek aadmi ne (dusre ke) bhai hone ka iqrar kiya, unhon ne kaha: Is ko daleel laani hogi ki woh is ka bhai hai.
Harith was asked: “A man, at the time of his death, acknowledged a Mudarabah (business partnership) of one thousand dirhams, and a debt of one thousand dirhams, while he left only one thousand dirhams. How should this be divided?”
He said: “First the debt will be paid, and if anything is left after that, then it will go to the Rabb-ul-Maal (i.e. the one who gave the dirhams for the business partnership).”

حارث عکلی نے کہا: ایک آدمی نے اپنی موت کے وقت ایک ہزار درہم کا مضاربت (تجارت) کے لئے اقرار کیا، اور ایک ہزار قرض کا، اور صرف ایک ہزار درہم چھوڑے؟ انہوں نے کہا: پہلے قرض ادا کیا جائے گا اور اگر اس کے بعد کچھ بچ گیا تو وہ صاحب مضاربت کے لئے (یعنی جس نے تجارت کے لئے درہم دیئے تھے اس کا) ہو گا۔
Haaris Aqli ne kaha: Ek aadmi ne apni mout ke waqt ek hazaar dirham ka mudarabat (tijarat) ke liye iqrar kiya, aur ek hazaar qarz ka, aur sirf ek hazaar dirham chhode? Unhon ne kaha: Pehle qarz ada kiya jaye ga aur agar is ke baad kuch bach gaya to woh sahib mudarabat ke liye (yani jis ne tijarat ke liye dirham diye the us ka) ho ga.
It is narrated on the authority of Sha'bi, may Allah have mercy on him: A man died and left behind three hundred dirhams and three sons. Then a man came and claimed one hundred dirhams from the deceased, and one of the three brothers acknowledged his claim. Sha'bi, may Allah have mercy on him, said: "He will take his share from them." Then he said: "I think the inheritance will be divided after the debt is paid."

شعبی رحمہ اللہ سے مروی ہے: ایک آدمی فوت ہو گیا اور تین سو درہم اور تین لڑکے چھوڑ گیا، اس کے بعد کوئی آدمی آیا اس نے میت پر سو درہم کا دعویٰ کیا اور ان تینوں بھائیوں میں سے ایک نے اس کا اقرار بھی کیا، شعبی رحمہ اللہ نے کہا: وہ ان سے اپنا حصہ لے گا، پھر کہا: میرا خیال ہے قرض دینے کے بعد میراث تقسیم ہو گی۔
Shabi rehmatullah alaih se marvi hai: Ek aadmi foot ho gaya aur teen sau dirham aur teen ladke chhor gaya, iske baad koi aadmi aaya usne mayyat par sau dirham ka daawa kiya aur in teeno bhaiyon mein se ek ne iska iqrar bhi kiya, Shabi rehmatullah alaih ne kaha: Woh in se apna hissa le ga, phir kaha: Mera khayal hai qarz dene ke baad miraas taqseem ho gi.
Narrated from Ash'ath: Hasan (may Allah have mercy on him) was asked about a man who died and left two sons and two thousand dirhams. The two brothers divided the two thousand dirhams between themselves. Then one of the boys disappeared. A man came and claimed one thousand dirhams from the other brother. Hasan (may Allah have mercy on him) said: The remaining brother will take what he has, and it will be said to the claimant, "Search for your brother and take half of what he has."

اشعث سے مروی ہے حسن رحمہ اللہ نے اس شخص کے بارے میں کہا جو انتقال کر گیا اور اپنے دو بیٹے اور دو ہزار درہم چھوڑ گیا، دونوں بھائیوں نے دو ہزار درہم تقسیم کر لئے پھر ان میں سے ایک لڑکا غائب ہو گیا اور ایک آدمی نے ہزار درہم کا دعویٰ کیا؟ حسن رحمہ اللہ نے کہا: موجود بھائی کے پاس جو کچھ ہے وہ مدعی لے لے گا اور کہا جائے گا کہ تم اپنے بھائی کو تلاش کر کے جو اس کے پاس ہو اس کا آدھا حصہ اس سے لے لو۔
Ashas se marvi hai hasan rehmatullah ne is shakhs ke bare mein kaha jo intiqal kar gaya aur apne do bete aur do hazar dirham chhor gaya, dono bhaiyon ne do hazar dirham taqseem kar liye phir un mein se ek ladka ghaib ho gaya aur ek aadmi ne hazar dirham ka daava kiya? Hasan rehmatullah ne kaha: maujood bhai ke paas jo kuchh hai wo muddai le lega aur kaha jayega ki tum apne bhai ko talaash kar ke jo us ke paas ho us ka aadha hissa us se le lo.
Hasan, may Allah have mercy on him, said: “When some of the inheritors acknowledge a debt (against the deceased) then they will pay off the debt from their (respective) shares.”

حسن رحمہ اللہ نے کہا: جب کچھ وارثین (مرنے والے پر) قرض کا اقرار کر لیں تو وہی اپنے حصہ سے قرض ادا کریں گے۔
Hasan rehmatullah alai ne kaha: jab kuchh warisin (marne wale par) qarz ka iqrar kar len to wohi apne hissa se qarz ada karenge.
Ibrahim (peace be upon him) said: When two inheritors are truthful and bear witness to the debt, the debt will be paid from the total estate. Imam Shabi (peace be upon him) said: Only those two will pay the debt from their share.

ابراہیم رحمہ اللہ نے کہا: جب دو وارث جو سچے ہوں اور قرض کی گواہی دیں تو کل مال سے قرض ادا کیا جائے گا، امام شعبی رحمہ اللہ نے کہا: بس وہی دونوں اپنے حصہ سے قرض ادا کریں گے۔
Ibraheem rehmatullah alaih ne kaha: jab do waris jo sache hon aur qarz ki gawahi den to kul maal se qarz ada kiya jaye ga, Imam Shabi rehmatullah alaih ne kaha: bas wohi donon apne hissa se qarz ada karenge.
