Chapter: It Is Disliked To Favor Some Of One's Children Over Others In Gift-Giving

باب كَرَاهَةِ تَفْضِيلِ بَعْضِ الأَوْلاَدِ فِي الْهِبَةِ ‏‏

Sahih Muslim 1623a

Nu'man bin Bashir (رضي الله تعالى عنه) reported that his father brought him to Allah's Apostle ( صلى الله عليه وآله وسلم) and said, I have donated this slave of mine to my son. Allah's Apostle ( صلى الله عليه وآله وسلم) said, have you donated to every one of your sons (a slave) like this? He said, no. Thereupon Allah's Apostle (صلى الله عليه وآله وسلم) said, then take him back.

حضرت نعمان بن بشیر رضی اللہ تعالی عنہ بیان کرتے ہیں کہ میرا باپ مجھے رسول اللہ صلی اللہ علیہ وسلم کے پاس لایا، اور عرض کیا، میں نے اپنے اس بچہ کو اپنا غلام ہبہ کر دیا ہے، تو رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”کیا تو نے اپنی تمام اولاد کو اسی قسم کا عطیہ دیا ہے؟“ تو اس نے کہا، نہیں، اس پر رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”اس (غلام) کو واپس لو۔“

Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) bayan karte hain ki mera baap mujhe Rasool Allah (Sallallahu Alaihi Wa Sallam) ke paas laya, aur arz kiya, maine apne is bachche ko apna ghulam hiba kar diya hai, to Rasool Allah (Sallallahu Alaihi Wa Sallam) ne farmaya: “Kya tu ne apni tamam aulad ko isi qism ka atiya diya hai?” To us ne kaha, nahi, is par Rasool Allah (Sallallahu Alaihi Wa Sallam) ne farmaya: “Is (ghulam) ko wapas lo.”

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنِ ابْنِ شِهَابٍ، عَنْ حُمَيْدِ بْنِ عَبْدِ، الرَّحْمَنِ وَعَنْ مُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ، يُحَدِّثَانِهِ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّهُ قَالَ إِنَّ أَبَاهُ أَتَى بِهِ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلاَمًا كَانَ لِي ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَكُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ هَذَا ‏"‏ ‏.‏ فَقَالَ لاَ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ فَارْجِعْهُ ‏"‏ ‏.‏

Sahih Muslim 1623b

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that his father brought him to Allah's Apostle ( صلى الله عليه وآله وسلم) and said, ‘I have donated this slave to my son. On this, the Prophet ( صلى هللا عليه وآله وسلم) asked ‘have you made (such) donation to everyone or your sons? He said, no. The Prophet (صلى الله عليه وآله وسلم) said, ’then take him back.’

حضرت نعمان بن بشیر رضی اللہ تعالی عنہ بیان کرتے ہیں کہ میرا باپ مجھے لے کر رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوا اور عرض کیا، میں نے اپنے اس بیٹے کو ایک غلام کا عطیہ دیا ہے، تو آپ صلی اللہ علیہ وسلم نے پوچھا: ”کیا تو نے تمام اولاد کو عطیہ دیا ہے؟“ اس نے کہا، نہیں، آپ صلی اللہ علیہ وسلم نے فرمایا، ”اسے واپس لے لو۔“

Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) bayan karte hain ki mera baap mujhe le kar Rasool Allah (Sallallahu Alaihi Wa Sallam) ki khidmat mein hazir hua aur arz kiya, maine apne is bete ko ek ghulam ka atiya diya hai, to Aap (Sallallahu Alaihi Wa Sallam) ne poocha: “Kya tu ne tamam aulad ko atiya diya hai?” Us ne kaha, nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya, “Usay wapas le lo.”

وَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَخْبَرَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، عَنْ حُمَيْدِ بْنِ، عَبْدِ الرَّحْمَنِ وَمُحَمَّدِ بْنِ النُّعْمَانِ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، قَالَ أَتَى بِي أَبِي إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلاَمًا ‏.‏ فَقَالَ ‏"‏ أَكُلَّ بَنِيكَ نَحَلْتَ ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَارْدُدْهُ ‏"‏ ‏.‏

Sahih Muslim 1623c

This Hadith has been narrated on the authority of Zuhri with different chains of transmitters and a slight variation of words.

امام صاحب اپنے بہت سے اساتذہ کی سندوں سے امام زہری ہی کے واسطہ سے مذکورہ بالا روایت بیان کرتے ہیں، امام زہری کے شاگرد معمر اور یونس کہتے ہیں، (أكل بنيك)

Imam Sahab apne bahut se asatiza ki sanadon se Imam Zuhri hi ke wasta se mazkoora bala riwayat bayan karte hain, Imam Zuhri ke shagird Mamar aur Younus kehte hain, (akul banik).

وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ، وَابْنُ أَبِي عُمَرَ، عَنِ ابْنِ عُيَيْنَةَ، ح وَحَدَّثَنَا قُتَيْبَةُ، وَابْنُ، رُمْحٍ عَنِ اللَّيْثِ بْنِ سَعْدٍ، ح وَحَدَّثَنِي حَرْمَلَةُ بْنُ يَحْيَى، أَخْبَرَنَا ابْنُ، وَهْبٍ قَالَ أَخْبَرَنِي يُونُسُ، ح وَحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، وَعَبْدُ بْنُ حُمَيْدٍ، قَالاَ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، كُلُّهُمْ عَنِ الزُّهْرِيِّ، بِهَذَا الإِسْنَادِ ‏.‏ أَمَّا يُونُسُ وَمَعْمَرٌ فَفِي حَدِيثِهِمَا ‏"‏ أَكُلَّ بَنِيكَ ‏"‏ ‏.‏ وَفِي حَدِيثِ اللَّيْثِ وَابْنِ عُيَيْنَةَ ‏"‏ أَكُلَّ وَلَدِكَ ‏"‏ ‏.‏ وَرِوَايَةُ اللَّيْثِ عَنْ مُحَمَّدِ بْنِ النُّعْمَانِ وَحُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ أَنَّ بَشِيرًا جَاءَ بِالنُّعْمَانِ ‏.‏

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that his father had donated a slave to him. Allah's Apostle (صلى الله عليه وآله وسلم) said, who is this slave (how have you come to possess it)? Nu'man bin Bashir (رضي الله تعالى عنه) said, my father has donated it to me. The Prophet ( صلى الله عليه وآله وسلم) said, have all brothers (of yours) been given this gift as given to you? He said, no. The Prophet (صلى الله عليه وآله وسلم) said, then return him.

حضرت نعمان بن بشیر رضی اللہ تعالی عنہ بیان کرتے ہیں کہ اس کے باپ نے اسے ایک غلام دیا، تو رسول اللہ صلی اللہ علیہ وسلم نے پوچھا، ”یہ غلام کیوں آیا ہے؟“ میں نے کہا، مجھے میرے باپ نے دیا ہے، آپ صلی اللہ علیہ وسلم نے فرمایا: ”کیا اس کے سب بھائیوں کو بھی اس طرح دیا ہے، جیسے اسے دیا ہے؟“ اس نے کہا، نہیں، آپ صلی اللہ علیہ وسلم نے فرمایا: ”غلام لوٹا دو۔“

Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) bayan karte hain ki us ke baap ne usay ek ghulam diya, to Rasool Allah (Sallallahu Alaihi Wa Sallam) ne poocha, “Yeh ghulam kyun aaya hai?” Maine kaha, mujhe mere baap ne diya hai, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “Kya is ke sab bhaiyon ko bhi is tarah diya hai, jaise usay diya hai?” Us ne kaha, nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “Ghulam lota do.”

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا جَرِيرٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، قَالَ حَدَّثَنَا النُّعْمَانُ بْنُ بَشِيرٍ، قَالَ وَقَدْ أَعْطَاهُ أَبُوهُ غُلاَمًا فَقَالَ لَهُ النَّبِيُّ صلى الله عليه وسلم ‏"‏ مَا هَذَا الْغُلاَمُ ‏"‏ ‏.‏ قَالَ أَعْطَانِيهِ أَبِي ‏.‏ قَالَ ‏"‏ فَكُلَّ إِخْوَتِهِ أَعْطَيْتَهُ كَمَا أَعْطَيْتَ هَذَا ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَرُدَّهُ ‏"‏ ‏.‏

My mother Amra bint Rawaha (رضي الله تعالى عنها) said, I shall not be pleased (with this act) until you make Allah's Apostle ( صلى الله عليه وآله وسلم) a witness to it. My father went to Allah's Apostle (صلى الله عليه وآله وسلم) in order to make him the witness of the donation given to me. Allah's Apostle (صلى الله عليه وآله وسلم) said to him, have you done the same with every son of yours? He said, no. The Prophet (صلى الله عليه وآله وسلم) said, fear Allah, and observe equity in case of your children. My father returned and got back the gift.

Nu'man b. Bashir reported: My father donated to me some of his property. حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبَّادُ بْنُ الْعَوَّامِ، عَنْ حُصَيْنٍ، عَنِ الشَّعْبِيِّ، قَالَ سَمِعْتُ النُّعْمَانَ بْنَ بَشِيرٍ، ح وَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى، - وَاللَّفْظُ لَهُ - أَخْبَرَنَا أَبُو الأَحْوَصِ، عَنْ حُصَيْنٍ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، قَالَ تَصَدَّقَ عَلَىَّ أَبِي بِبَعْضِ مَالِهِ فَقَالَتْ أُمِّي عَمْرَةُ بِنْتُ رَوَاحَةَ لاَ أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللَّهِ صلى الله عليه وسلم ‏.‏ فَانْطَلَقَ أَبِي إِلَى النَّبِيِّ صلى الله عليه وسلم لِيُشْهِدَهُ عَلَى صَدَقَتِي فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَفَعَلْتَ هَذَا بِوَلَدِكَ كُلِّهِمْ ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ اتَّقُوا اللَّهَ وَاعْدِلُوا فِي أَوْلاَدِكُمْ ‏"‏ ‏.‏ فَرَجَعَ أَبِي فَرَدَّ تِلْكَ الصَّدَقَةَ ‏.‏

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that his mother bint Rawaha (رضي الله تعالى عنها) asked his father about donating some gifts from his property to his son. He deferred the matter by one year, and then set forth to do that. She said, I shall not be pleased unless you call Allah's Apostle (صلى الله عليه وآله وسلم) as witness to what you confer as a gift on your son. So, the father took hold of his hand and he was at that time a boy and came to Allah's Apostle ( صلى الله عليه وآله وسلم). and said, Allah's Apostle ( صلى الله عليه وآله وسلم), the mother of this son (of mine), daughter of Rawaha (رضي الله تعالى عنه) wishes that I should call you witness to what I confer as gift to her son. Allah's Apostle (صلى الله عليه وآله وسلم) said, Bashir (رضي الله تعالى عنه), have you any other son besides this (son of yours)? He said, yes. The Prophet (صلى الله عليه وآله وسلم) said, have you given gifts to all of them like this? He said, no. Then the Prophet (صلى الله عليه وآله وسلم) said, call me not as witness, for I cannot be witness to an injustice.’

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، عَنْ أَبِي حَيَّانَ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، ح. وَحَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، - وَاللَّفْظُ لَهُ - حَدَّثَنَا مُحَمَّدُ بْنُ بِشْرٍ، حَدَّثَنَا أَبُو حَيَّانَ التَّيْمِيُّ، عَنِ الشَّعْبِيِّ، حَدَّثَنِي النُّعْمَانُ بْنُ بَشِيرٍ، أَنَّ أُمَّهُ بِنْتَ رَوَاحَةَ، سَأَلَتْ أَبَاهُ بَعْضَ الْمَوْهِبَةِ مِنْ مَالِهِ لاِبْنِهَا فَالْتَوَى بِهَا سَنَةً ثُمَّ بَدَا لَهُ فَقَالَتْ لاَ أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللَّهِ صلى الله عليه وسلم عَلَى مَا وَهَبْتَ لاِبْنِي ‏.‏ فَأَخَذَ أَبِي بِيَدِي وَأَنَا يَوْمَئِذٍ غُلاَمٌ فَأَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ أُمَّ هَذَا بِنْتَ رَوَاحَةَ أَعْجَبَهَا أَنْ أُشْهِدَكَ عَلَى الَّذِي وَهَبْتُ لاِبْنِهَا ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ يَا بَشِيرُ أَلَكَ وَلَدٌ سِوَى هَذَا ‏"‏ ‏.‏ قَالَ نَعَمْ ‏.‏ فَقَالَ ‏"‏ أَكُلَّهُمْ وَهَبْتَ لَهُ مِثْلَ هَذَا ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَلاَ تُشْهِدْنِي إِذًا فَإِنِّي لاَ أَشْهَدُ عَلَى جَوْرٍ ‏"‏ ‏.‏

Sahih Muslim 1623g

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) had said, have you, besides him, other sons? He said, yes. Thereupon the Prophet (صلى الله عليه وآله وسلم) said, have you given gifts to all of them like this? He said, no. The Prophet (صلى الله عليه وآله وسلم) said, I cannot bear witness to an injustice.

حضرت نعمان بن بشیر رضی اللہ تعالی عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”کیا اس کے سوا، تیرے بیٹے ہیں؟“ اس نے کہا، جی ہاں، آپ صلی اللہ علیہ وسلم نے فرمایا: ”تو کیا سب کو اسی طرح دیا ہے؟“ اس نے کہا، نہیں، آپصلی اللہ علیہ وسلم نے فرمایا: ”تو میں ظلم پر گواہ نہیں بنتا۔“

Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) se riwayat hai ki Rasool Allah (Sallallahu Alaihi Wa Sallam) ne farmaya: “Kya is ke siwa, tere bete hain?” Us ne kaha, ji haan, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To kya sab ko isi tarah diya hai?” Us ne kaha, nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To main zulm par gawah nahi banta.”

حَدَّثَنَا ابْنُ نُمَيْرٍ، حَدَّثَنِي أَبِي، حَدَّثَنَا إِسْمَاعِيلُ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ أَلَكَ بَنُونَ سِوَاهُ ‏"‏ ‏.‏ قَالَ نَعَمْ ‏.‏ قَالَ ‏"‏ فَكُلَّهُمْ أَعْطَيْتَ مِثْلَ هَذَا ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَلاَ أَشْهَدُ عَلَى جَوْرٍ ‏"‏ ‏.‏

Sahih Muslim 1623h

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) said, to his father, call me not as witness to an injustice.

حضرت نعمان بن بشیر رضی اللہ تعالی عنہ بیان کرتے ہیں، رسول اللہ صلی اللہ علیہ وسلم نے اس کے باپ سے فرمایا: ”مجھے ظلم پر گواہ نہ بنا۔“

Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) bayan karte hain, Rasool Allah (Sallallahu Alaihi Wa Sallam) ne us ke baap se farmaya: “Mujhe zulm par gawah na bana.”

حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَخْبَرَنَا جَرِيرٌ، عَنْ عَاصِمٍ الأَحْوَلِ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ لأَبِيهِ ‏ "‏ لاَ تُشْهِدْنِي عَلَى جَوْرٍ ‏"‏ ‏.‏

Sahih Muslim 1623i

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that his father took him to Allah's Apostle ( صلى الله عليه وآله وسلم) and said, Allah's Apostle (صلى الله عليه وآله وسلم), bear witness that I have given such and such gift to Nu'man (رضي الله تعالى عنه) from my property, whereupon the Prophet ( صلى هللا عليه و آلهوسلم) said, have you conferred upon all of your sons as you have conferred upon Nu'man (رضي الله تعالى عنه)? He said, no. Thereupon the Prophet (صلى الله عليه وآله وسلم) said, call someone else besides me as a witness. And said, would it, please you that they (your children) should all behave respectfully towards you? He said, yes. The Prophet (صلى الله عليه وآله وسلم) said, then do not do that.

امام صاحب اپنے مختلف اساتذہ کی سندوں سے بیان کرتے ہیں کہ حضرت نعمان بن بشیر رضی اللہ تعالی عنہ نے بتایا کہ میرا باپ مجھے اٹھا کر رسول اللہ صلی اللہ علیہ وسلم کی طرف روانہ ہوا اور آپ صلی اللہ علیہ وسلم سے عرض کیا، اے اللہ کے رسول! گواہ ہو جائیے کہ میں نے نعمان کو اپنے مال سے یہ یہ دیا ہے، تو آپصلی اللہ علیہ وسلم نے فرمایا: ”کیا تم نے اپنے سب بیٹوں کو نعمان جیسا عطیہ دیا ہے؟“ اس نے کہا، نہیں، آپصلی اللہ علیہ وسلم نے فرمایا: ”تو اس پر میرے سوا کسی اور کو گواہ بنا لے۔“ پھر آپصلی اللہ علیہ وسلم نے فرمایا: ”کیا تمہیں یہ بات اچھی لگتی ہے کہ وہ تیرے ساتھ وفا کرنے میں یکساں ہوں؟“ اس نے کہا، کیوں نہیں، آپصلی اللہ علیہ وسلم نے فرمایا: ”تو تب، ایسا نہ کر۔“

Imam Sahab apne mukhtalif asatiza ki sanadon se bayan karte hain ki Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) ne bataya ki mera baap mujhe utha kar Rasool Allah (Sallallahu Alaihi Wa Sallam) ki taraf rawana hua aur Aap (Sallallahu Alaihi Wa Sallam) se arz kiya, aye Allah ke Rasool! Gawah ho jayiye ki maine Nu'man ko apne maal se yeh yeh diya hai, to Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “Kya tum ne apne sab beton ko Nu'man jaisa atiya diya hai?” Us ne kaha, nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To is par mere siwa kisi aur ko gawah bana le.” Phir Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “Kya tumhein yeh baat achhi lagti hai ki woh tere saath wafa karne mein yaksaan hon?” Us ne kaha, kyun nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To tab, aisa na kar.”

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا عَبْدُ الْوَهَّابِ، وَعَبْدُ الأَعْلَى، ح وَحَدَّثَنَا إِسْحَاقُ، بْنُ إِبْرَاهِيمَ وَيَعْقُوبُ الدَّوْرَقِيُّ جَمِيعًا عَنِ ابْنِ عُلَيَّةَ، - وَاللَّفْظُ لِيَعْقُوبَ - قَالَ حَدَّثَنَا إِسْمَاعِيلُ، بْنُ إِبْرَاهِيمَ عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، قَالَ انْطَلَقَ بِي أَبِي يَحْمِلُنِي إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ اشْهَدْ أَنِّي قَدْ نَحَلْتُ النُّعْمَانَ كَذَا وَكَذَا مِنْ مَالِي ‏.‏ فَقَالَ ‏"‏ أَكُلَّ بَنِيكَ قَدْ نَحَلْتَ مِثْلَ مَا نَحَلْتَ النُّعْمَانَ ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَأَشْهِدْ عَلَى هَذَا غَيْرِي - ثُمَّ قَالَ - أَيَسُرُّكَ أَنْ يَكُونُوا إِلَيْكَ فِي الْبِرِّ سَوَاءً ‏"‏ ‏.‏ قَالَ بَلَى ‏.‏ قَالَ ‏"‏ فَلاَ إِذًا ‏"‏ ‏.‏

Sahih Muslim 1623j

Nu'man bin Bashir (رضي الله تعالى عنه) narrated that his father conferred a gift upon him, and then brought him to Allah's Apostle ( صلى الله عليه وآله وسلم) to make him a witness (to it). The Prophet ( صلى الله عليه وآله وسلم) said, have you given such gift to every son of yours (as you have given to Nu'man)? He said, no. Thereupon he the Prophet (صلى الله عليه وآله وسلم) said, do not you expect goodness from them as you expect from him? He said, yes, of course. The Prophet ( صلى الله عليه وآله وسلم) said, I am not going to bear witness to it (as it is injustice). Ibn Aun (one of the narrators) said, I narrated this Hadith to Muhammad (the other narrator) who said, verily we narrated that lie (the Prophet ﷺ) had said, observe equity amongst your children.

حضرت نعمان بن بشیر رضی اللہ تعالی عنہ بیان کرتے ہیں، کہ میرے باپ نے مجھے عطیہ دیا، پھر وہ مجھے لے کر رسول اللہ صلی اللہ علیہ وسلم کے پاس آیا، تاکہ آپصلی اللہ علیہ وسلم کو گواہ بنائے، تو آپصلی اللہ علیہ وسلم نے پوچھا، ”کیا تو نے اپنی سب اولاد کو یہ دیا ہے؟“ اس نے کہا، نہیں، آپصلی اللہ علیہ وسلم نے فرمایا: ”کیا تو ان سے اس طرح کا حسن سلوک نہیں چاہتا، جیسا کہ اس سے چاہتا ہے؟“ اس نے کہا، کیوں نہیں، آپصلی اللہ علیہ وسلم نے فرمایا: ”تو میں گواہ نہیں بنتا“۔ ابن عون کہتے ہیں، میں نے یہ روایت محمد بن سیرین کو سنائی، تو اس نے کہا، ہمیں یوں بتایا گیا ہے کہ آپصلی اللہ علیہ وسلم نے فرمایا: ”اپنی اولاد میں مساوات رکھو۔“

Hazrat Nu'man Bin Bashir (Razi Allahu Ta'ala Anhu) bayan karte hain, ki mere baap ne mujhe atiya diya, phir woh mujhe le kar Rasool Allah (Sallallahu Alaihi Wa Sallam) ke paas aaya, taaki Aap (Sallallahu Alaihi Wa Sallam) ko gawah banaye, to Aap (Sallallahu Alaihi Wa Sallam) ne poocha, “Kya tu ne apni sab aulad ko yeh diya hai?” Us ne kaha, nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “Kya tu un se is tarah ka husn sulook nahi chahta, jaisa ki is se chahta hai?” Us ne kaha, kyun nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To main gawah nahi banta”. Ibn Aun kehte hain, maine yeh riwayat Muhammad Bin Sireen ko sunayi, to us ne kaha, hamein yoon bataya gaya hai ki Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “Apni aulad mein musawat rakho.”

حَدَّثَنَا أَحْمَدُ بْنُ عُثْمَانَ النَّوْفَلِيُّ، حَدَّثَنَا أَزْهَرُ، حَدَّثَنَا ابْنُ عَوْنٍ، عَنِ الشَّعْبِيِّ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، قَالَ نَحَلَنِي أَبِي نُحْلاً ثُمَّ أَتَى بِي إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم لِيُشْهِدَهُ فَقَالَ ‏"‏ أَكُلَّ وَلَدِكَ أَعْطَيْتَهُ هَذَا ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ أَلَيْسَ تُرِيدُ مِنْهُمُ الْبِرَّ مِثْلَ مَا تُرِيدُ مِنْ ذَا ‏"‏ ‏.‏ قَالَ بَلَى ‏.‏ قَالَ ‏"‏ فَإِنِّي لاَ أَشْهَدُ ‏"‏ ‏.‏ قَالَ ابْنُ عَوْنٍ فَحَدَّثْتُ بِهِ مُحَمَّدًا فَقَالَ إِنَّمَا تَحَدَّثْنَا أَنَّهُ قَالَ ‏"‏ قَارِبُوا بَيْنَ أَوْلاَدِكُمْ ‏"‏ ‏.‏

Sahih Muslim 1624

Jabir (رضي الله تعالى عنه) narrated that the wife of Bashir ( رضي الله تعالى عنه) said (to her husband), give to my son your slave as a gift, and make for me Allah's Apostle (صلى الله عليه وآله وسلم) a witness. He came to Allah's Apostle (صلى الله عليه وآله وسلم) and said, the daughter of so and so (his wife Amra bint Rawaha رضي الله تعالى عنها) asked me to give my slave as a gift to her son and call for me Allah's Apostle (صلى الله عليه وآله وسلم) as a witness. Thereupon the Prophet ( صلى الله عليه وآله وسلم) said, has he (Nu'man) brothers? He (Bashir) said, yes. He again asked, have you given to all others as you have given to him? He said, no. He said, it is not fair; and surely, I cannot bear witness but only to what is just.

حضرت جابر رضی اللہ تعالی عنہ بیان کرتے ہیں بشیر رضی اللہ تعالی عنہ کی بیوی نے کہا، میرے بیٹے کو اپنا غلام ہبہ کر دو اور مجھے رسول اللہ صلی اللہ علیہ وسلم کو گواہ بنا کر دو، تو وہ رسول اللہ صلی اللہ علیہ وسلم کے پاس آئے اور کہا، فلاں کی بیٹی نے مجھ سے مطالبہ کیا ہے کہ میں اس کے بیٹے کو اپنا غلام عطیہ میں دوں، اور کہا ہے، میرے لیے رسول اللہ صلی اللہ علیہ وسلم کو گواہ بناؤ، تو آپ صلی اللہ علیہ وسلم نے پوچھا: ”کیا اس کے بھائی ہیں؟“ اس نے کہا، جی ہاں، آپ صلی اللہ علیہ وسلم نے فرمایا: ”تو کیا ان سب کو وہی چیز دی ہے، جو اس کو دی ہے؟“ اس نے کہا، نہیں، آپصلی اللہ علیہ وسلم نے فرمایا: ”تو یہ درست نہیں ہے اور میں صرف صحیح چیز پر ہی گواہ بنتا ہوں۔“

Hazrat Jabir (Razi Allahu Ta'ala Anhu) bayan karte hain Bashir (Razi Allahu Ta'ala Anhu) ki biwi ne kaha, mere bete ko apna ghulam hiba kar do aur mujhe Rasool Allah (Sallallahu Alaihi Wa Sallam) ko gawah bana kar do, to woh Rasool Allah (Sallallahu Alaihi Wa Sallam) ke paas aaye aur kaha, falaan ki beti ne mujh se mutalba kiya hai ki main us ke bete ko apna ghulam atiya mein doon, aur kaha hai, mere liye Rasool Allah (Sallallahu Alaihi Wa Sallam) ko gawah banao, to Aap (Sallallahu Alaihi Wa Sallam) ne poocha: “Kya is ke bhai hain?” Us ne kaha, ji haan, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To kya un sab ko wahi cheez di hai, jo is ko di hai?” Us ne kaha, nahi, Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: “To yeh durust nahi hai aur main sirf sahih cheez par hi gawah banta hoon.”

حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ يُونُسَ، حَدَّثَنَا زُهَيْرٌ، حَدَّثَنَا أَبُو الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَتِ امْرَأَةُ بَشِيرٍ انْحَلِ ابْنِي غُلاَمَكَ وَأَشْهِدْ لِي رَسُولَ اللَّهِ صلى الله عليه وسلم ‏.‏ فَأَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنَّ ابْنَةَ فُلاَنٍ سَأَلَتْنِي أَنْ أَنْحَلَ ابْنَهَا غُلاَمِي وَقَالَتْ أَشْهِدْ لِي رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ ‏"‏ أَلَهُ إِخْوَةٌ ‏"‏ ‏.‏ قَالَ نَعَمْ ‏.‏ قَالَ ‏"‏ أَفَكُلَّهُمْ أَعْطَيْتَ مِثْلَ مَا أَعْطَيْتَهُ ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَلَيْسَ يَصْلُحُ هَذَا ‏.‏ وَإِنِّي لاَ أَشْهَدُ إِلاَّ عَلَى حَقٍّ ‏"‏ ‏.‏
