Thaabit bin Qays bin Shammas narrated that the Messenger of Allah (ﷺ) asked: "Who is this?" She said: "Habibah bint Sahl." He asked: "What is the matter?" She said: "My husband Thabit and I cannot live together." When Thabit bin Qays came, the Messenger of Allah (ﷺ) said: "This is Habibah bint Sahl who mentioned what Allah willed." She said: "O Messenger of Allah! All the wealth that he gave me is with me." So you (ﷺ) said: "Thabit, take your wealth from her." So he took it and she went to her family's house.

(١٤٨٣٦) ثابت بن قیس بن شماس فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : یہ کون ہے ؟ کہنے لگی : حبیبہ بنت سہل، پوچھا : تیری کیا حالت ہے ؟ کہتی ہیں کہ میں اور میرے خاوند ثابت اکٹھے نہیں رہ سکتے۔ جب ثابت بن قیس آئے تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : یہ حبیبہ بنت سہل ہے جو اللہ نے چاہا اس نے تذکرہ کیا، کہنے لگی : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! جو اس نے مجھے دیا ہے وہ تمام مال میرے پاس موجود ہے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ثابت مال اس سے لے لو تو انھوں نے لے لیا اور وہ اپنے اہل کے گھر بیٹھ گئی۔
14836 Sabit bin Qais bin Shamas farmate hain ki Rasul Allah ((صلى الله عليه وآله وسلم)) ne pucha: Yeh kaun hai? Kehne lagi: Habibah bint Sahl, pucha: Teri kya halat hai? Kehti hain ki main aur mere khaavand Sabit ikatthe nahi reh sakte. Jab Sabit bin Qais aaye to Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Yeh Habibah bint Sahl hai jo Allah ne chaha usne tazkara kiya, kehne lagi: Aye Allah ke Rasul ((صلى الله عليه وآله وسلم))! Jo usne mujhe diya hai woh tamam maal mere paas maujood hai to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Sabit maal usse le lo to unhonne le liya aur woh apne ahl ke ghar beth gayi.
Habiba bint Sahl complained to the Prophet (peace and blessings be upon him) in the dark and was showing something on her body. She said: "Thabet and I cannot live together." So the Messenger of Allah (peace and blessings be upon him) said: "O Thabet! Take your belongings." So he took his belongings, and she stayed in her house.

(١٤٨٣٧) عمرہ فرماتی ہیں کہ حبیبہ بنت سہل نے نبی (صلی اللہ علیہ وآلہ وسلم) کو آکر اندھیرے میں شکایت کی اور وہ اپنے بدن پر کچھ دکھا رہی تھیں۔ کہنے لگیں : میں اور ثابت اکٹھے نہیں رہ سکتے تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اے ثابت ! اپنا مال لے، لو انھوں نے اپنا مال لے لیا اور وہ اپنے گھر بیٹھ گئی۔
(14837) Umrah farmati hain keh Habibah Bint Sahl ne Nabi ((صلى الله عليه وآله وسلم)) ko aakar andhere mein shikayat ki aur wo apne badan par kuch dikha rahi thin. Kehne lagi: mein aur Sabit ikatthe nahi reh sakte to Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Aye Sabit! Apna maal le, lo unhon ne apna maal le liya aur wo apne ghar beth gai.
Abdullah bin Abbas (may Allah be pleased with him) narrated that the wife of Thabit bin Qais came to the Prophet (peace and blessings of Allah be upon him) and said: “O Messenger of Allah! I do not find any fault with the religion or character of Thabit, but I dislike to be ungrateful in Islam.” He (peace and blessings of Allah be upon him) asked: “Will you give back his garden?” She said: “Yes.” He (peace and blessings of Allah be upon him) said: “Thabit, take your garden and divorce her once.”

(١٤٨٣٨) حضرت عبداللہ بن عباس (رض) فرماتے ہیں کہ ثابت بن قیس کی بیوی نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور کہا : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! میں ثابت کے دین و اخلاق میں عیب نہیں لگاتی، لیکن اسلام میں ناشکری کو ناپسند کرتی ہوں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : کیا تو اس کا باغ واپس کر دے گی، کہتی ہیں : ہاں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ثابت اپنا باغ لے کر اس کو طلاق دے دو ۔
Hazrat Abdullah bin Abbas (RA) farmate hain ki Sabit bin Qais ki biwi Nabi (SAW) ke pass aai aur kaha: Aye Allah ke Rasool (SAW)! Main Sabit ke deen o akhlaq mein aib nahi lagati, lekin Islam mein nashukri ko napasand karti hun. Aap (SAW) ne pucha: kya tu us ka bagh wapas kar degi, kehti hain: Haan. Aap (SAW) ne farmaya: Sabit apna bagh lekar us ko talaq de do.
(14840) Narrated Abdullah bin Abbas (RA): The wife of Thabit bin Qais bin Shammas came to the Messenger of Allah (ﷺ) and said, “O Messenger of Allah! I do not find any fault with Thabit in his religion or character, but I dislike to commit an act of Kufr (disbelief) in Islam.” The Prophet (ﷺ) asked her, “Will you return his garden (which he gave you as Mahr)?” She said, “Yes.” So, the Prophet (ﷺ) ordered Thabit to take back his garden, and separated them.
(b) In the narration of Qatadah from Abu Al-Nuh: (It is said) When she returned the garden, the Prophet (ﷺ) ordered her to separate from him.

(١٤٨٤٠) حضرت عبداللہ بن عباس (رض) فرماتے ہیں کہ ثابت بن قیس بن شماس کی بیوی رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی۔ کہنے لگی : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! میں ثابت کے دین و اخلاق میں عیب نہیں لگاتی؛ کیونکہ اسلام میں ناشکری کو پسند نہیں کرتی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : کیا تو اس کا باغ واپس کر دے گی ؟ اس عورت نے کہا : ہاں تو آپ (صلی اللہ علیہ وآلہ وسلم) نے باغ واپس کرنے کا حکم دے دیا اور ان کے درمیان تفریق کروا دی۔
(ب) قراد ابی نوح سے نقل فرماتے ہیں کہ اس عورت نے باغ واپس کردیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کو جدا کرنے کا حکم دے دیا۔
(14840) Hazrat Abdullah bin Abbas (RA) farmate hain ki Sabit bin Qais bin Shammas ki biwi Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas aai. Kehne lagi: Aye Allah ke Rasul ((صلى الله عليه وآله وسلم))! Main Sabit ke deen-o-akhlaq mein aib nahin lagati; kyunki Islam mein nashukri ko pasand nahin karti. Aap ((صلى الله عليه وآله وسلم)) ne pucha: kya tu us ka bagh wapas kar degi? Us aurat ne kaha: Haan. To Aap ((صلى الله عليه وآله وسلم)) ne bagh wapas karne ka hukum de diya aur un ke darmiyan tafreeq karwa di.
(b) Qarad Abi Noah se naql farmate hain ki us aurat ne bagh wapas kar diya to Aap ((صلى الله عليه وآله وسلم)) ne us ko juda karne ka hukum de diya.
Abdullah bin Abbas (may Allah be pleased with him) narrated that Jameela bint Salul came to the Prophet (peace and blessings of Allah be upon him). She wanted to dissolve her marriage (Khula). He (peace and blessings of Allah be upon him) asked her, "What was your dowry?" She said, "A garden." He (peace and blessings of Allah be upon him) said, "Return her garden to her."

(١٤٨٤١) حضرت عبداللہ بن عباس (رض) فرماتے ہیں کہ جمیلہ بنت سلول نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی، وہ خلع کا رادہ رکھتی تھی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : تیرا حق مہر کیا تھا ؟ اس عورت نے کہا : باغ۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اس کا باغ واپس کر دو ۔
Hazrat Abdullah bin Abbas (RA) farmate hain ki Jamila bint Salool Nabi (SAW) ke pass aayi, woh khula ka iraada rakhti thi. Aap (SAW) ne poocha: tera haq mehr kya tha? Uss aurat ne kaha: bagh. Aap (SAW) ne farmaya: uss ka bagh wapas kar do.
Abdullah bin Abbas (may Allah be pleased with him) narrated that Jamilah bint Salul came to the Prophet (peace and blessings of Allah be upon him). She said: "May my father and mother be sacrificed for you! I do not find any fault in the religion and character of Thabit bin Qais bin Shammas. But I cannot stand him and I dislike ungratefulness in Islam." You asked, "Will you return his garden to him?" She replied: "Yes." You (peace and blessings of Allah be upon him) ruled: "Take back what you have given as dowry and do not take more than that."

(١٤٨٤٢) حضرت عبداللہ بن عباس (رض) فرماتے ہیں کہ جمیلہ بنت سلول نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی۔ اس نے کہا : میرے ماں، باپ آپ پر قربان ! میں ثابت بن قیس بن شماس کے دین و اخلاق میں عیب نہیں لگاتی۔ لیکن میں بغض کی بھی طاقت نہیں رکھتی اور اسلام میں ناشکری کو ناپسند کرتی ہوں، آپ نے پوچھا : کیا تو اسے اس کا باغ لوٹا دے گی ؟ اس نے کہا : ہاں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے حکم دیا : جو مال دیا ہے وہ واپس لے لو زیادہ نہیں لینا۔
(14842) Hazrat Abdullah bin Abbas (RA) farmate hain keh Jamila bint Salool Nabi ((صلى الله عليه وآله وسلم)) ke paas aayi. Us ne kaha : mere maan, baap aap per qurban! Main Sabit bin Qais bin Shamas ke deen-o-akhlaq mein aib nahin lagati. Lekin main bughz ki bhi taaqat nahin rakhti aur Islam mein nashukri ko napasand karti hun, aap ne poocha : kya tu use uska bagh luta de gi? Us ne kaha : haan. Aap ((صلى الله عليه وآله وسلم)) ne hukm diya : jo maal diya hai woh wapas le lo zyada nahin lena.
Abu Nasr Abdul Wahab bin Ata said: I asked Saeed about a woman who demands more than her dowry back in exchange for divorce. He said that Qatada narrated from Ikrimah that Jameela bint Salool came to the Messenger of Allah (peace be upon him) and said: My husband is Thabit bin Qais. I do not find any fault in him. The Messenger of Allah (peace be upon him) separated them. You (peace be upon him) said: Take back what you gave, but do not take more. Qatada narrated from Ikrimah: I do not remember the phrase 'La Tadhdi'.

(١٤٨٤٣) ابونصر عبدالوہاب بن عطاء فرماتے ہیں میں نے سعید سے پوچھا کہ جو شخص زیادہ مال کی واپسی کا تقاضا کر کے خلع کرنا چاہتا ہے، انھوں نے بیان کیا کہ قتادہ حضرت عکرمہ سے روایت کرتے ہیں کہ جمیلہ بنت سلول رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور کہنے لگی : میرا خاوند ثابت قیس ہے۔ میں اس پر عیب نہیں لگاتی، رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے دونوں کے درمیان تفریق کروا دی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو دیا ہے واپس لے لو لیکن زیادہ نہ لینا۔ قتادہ عکرمہ سے نقل فرماتے ہیں کہ لا تذدد کے الفاظ مجھے یاد نہیں ہیں۔
14843 Abonasr Abdulillah bin Ata farmate hain maine Saeed se poocha ke jo shakhs zyada mal ki wapsi ka taqaaza kar ke khula karna chahta hai unhon ne bayan kya ke Qatada Hazrat Ukrama se riwayat karte hain ke Jamila bint Salool Rasool Allah ((صلى الله عليه وآله وسلم)) ke pass aayi aur kehne lagi mera khaawand Sabit Qais hai main is par aib nahi lagati Rasool Allah ((صلى الله عليه وآله وسلم)) ne donon ke darmiyan tafreeq karwa di aap ((صلى الله عليه وآله وسلم)) ne farmaya jo diya hai wapis le lo lekin zyada na lena Qatada Ukrama se naqal farmate hain ke la tazdid ke alfaz mujhe yaad nahi hain.
Ibn Juraij narrated from Ata that a woman came and complained to the Prophet (peace and blessings of Allah be upon him) about her husband. He (peace and blessings of Allah be upon him) asked: "Will you return his garden?" She said: "Yes, and I will give him more." He said: "No more."

(١٤٨٤٤) ابن جریج حضرت عطاء سے نقل فرماتے ہیں کہ ایک عورت نے آکر نبی (صلی اللہ علیہ وآلہ وسلم) کو اپنے خاوند کی شکایت کی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : کیا تو اس کا باغ واپس کرتی ہے ؟ کہنے لگی : ہاں کچھ زیادہ بھی دوں گی۔ فرمایا : زیادہ نہیں۔
Ibn Juraij Hazrat Ata se naql farmate hain ki ek aurat ne aakar Nabi ((صلى الله عليه وآله وسلم)) ko apne khaavand ki shikayat ki. Aap ((صلى الله عليه وآله وسلم)) ne poocha : kya tu us ka bagh wapas karti hai ? Kehne lagi : haan kuchh ziada bhi dungi. Farmaya : ziada nahi.
Ata said that a woman said to the Prophet (peace and blessings of Allah be upon him): I hate my husband and I want separation. He (peace and blessings of Allah be upon him) said: Will you return the garden that he gave you as dowry?
The narrator said that her dowry was a garden. She said: Yes, and I will give more. He (peace and blessings of Allah be upon him) said: The extra is yours, just return the garden. She said: Okay. So he (peace and blessings of Allah be upon him) said, when he heard of the Prophet's (peace and blessings of Allah be upon him) decision, he said: I agree with the Prophet's (peace and blessings of Allah be upon him) decision.

(١٤٨٤٥) حضرت عطاء فرماتے ہیں کہ ایک عورت نے نبی (صلی اللہ علیہ وآلہ وسلم) سے کہا : میں اپنے خاوند سے بغض رکھتی ہوں اور میں تفریق چاہتی ہوں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو اس نے تجھے حق مہر میں باغ دیا تھا واپس کرتی ہو ؟
راوی بیان کرتے ہیں کہ اس کا حق مہر باغ تھا۔ کہتی ہے : ہاں اور زیادہ بھی دیتی ہوں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : زیادہ تیرا مال ہے، صرف باغ واپس کر دو ۔ کہتی ہے : ٹھیک تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرما دیا، جب اسے نبی (صلی اللہ علیہ وآلہ وسلم) کے فیصلے کی خبر ملی تو اس نے کہا : مجھے نبی (صلی اللہ علیہ وآلہ وسلم) کا فیصلہ منظور ہے۔
(14845) Hazrat Ata farmate hain keh ek aurat ne Nabi ((صلى الله عليه وآله وسلم)) se kaha : mein apne khawand se bughz rakhti hun aur mein tafreeq chahti hun. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : jo usne tujhe haq mehr mein bagh diya tha wapas karti ho ?
Ravi bayan karte hain keh uska haq mehr bagh tha. Kehti hai : haan aur ziada bhi deti hun. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : ziada tera maal hai, sirf bagh wapas kar do. Kehti hai : theek to Aap ((صلى الله عليه وآله وسلم)) ne farma diya, jab use Nabi ((صلى الله عليه وآله وسلم)) ke faisle ki khabar mili to usne kaha : mujhe Nabi ((صلى الله عليه وآله وسلم)) ka faisla manzoor hai.
Ibn Juraij narrated from Ata that he was informed on the authority of the Prophet (ﷺ) that he said: "From the woman seeking Khula, nothing is to be taken more than what was given (as dowry)."

(١٤٨٤٦) ابن جریج حضرت عطاء سے نقل فرماتے ہیں کہ انھیں نبی (صلی اللہ علیہ وآلہ وسلم) سے خبر ملی کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : خلع کرنے والی عورت سے دیے ہوئے مال سے زیادہ نہ لیا جائے۔
(14846) ibne juraij hazrat ata se naql farmate hain ke unhen nabi ((صلى الله عليه وآله وسلم)) se khabar mili ke aap ((صلى الله عليه وآله وسلم)) ne farmaya : khula karne wali aurat se diye huwe maal se ziada na liya jaye.
Ibn Juraij narrated from Ata that the Prophet (peace and blessings of Allah be upon him) did not like to take more from a woman seeking khula (divorce initiated by wife) than what he had given her.

(١٤٨٤٧) ابن جریج حضرت عطاء سے نقل فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) خلع کرنے والی عورت سے دیے ہوئے مال سے زیادہ لینا پسند نہ کرتے تھے۔

Ata' narrates from Abdullah bin Abbas (may Allah be pleased with him) that a man came to the Prophet (peace and blessings of Allah be upon him) complaining about his wife. The Prophet (peace and blessings of Allah be upon him) asked the wife, "Will you return his garden to him?" She replied, "Yes, and I will give him even more." The Prophet (peace and blessings of Allah be upon him) forbade her from giving more.

(١٤٨٤٨) عطاء حضرت عبداللہ بن عباس (رض) سے نقل فرماتے ہیں کہ ایک شخص اپنی بیوی کا جھگڑا لے کر نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا تو نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کیا تو اس کا باغ واپس کرتی ہے ؟ کہنے لگی : باغ اور زیادہ بھی دے دیتی ہوں تو نبی (صلی اللہ علیہ وآلہ وسلم) نے زیادہ دینے سے منع فرما دیا۔
Ata Hazrat Abdullah bin Abbas (RA) se naqal farmate hain ke ek shakhs apni biwi ka jhagda lekar Nabi (SAW) ke paas aaya to Nabi (SAW) ne farmaya : kya tu us ka bagh wapas karti hai ? kahne lagi : bagh aur ziada bhi de deti hun to Nabi (SAW) ne ziada dene se mana farma diya.
Abu Zubair narrated that Zainab bint Abdullah bin Abi bin Salul was married to Thabit bin Qais bin Shammas. Her dowry was a garden. When her husband disliked her, the Prophet (peace and blessings of Allah be upon him) said: "Will you return the garden he gave you?" She said: "Yes, the garden and even more." The Prophet (peace and blessings of Allah be upon him) said: "Only return the garden, nothing more." She said: "Yes." Her husband took the garden and divorced her. When Thabit bin Qais bin Shammas came to know about the decision of the Prophet (peace and blessings of Allah be upon him), he accepted it.

(١٤٨٤٩) ابو زبیر فرماتے ہیں کہ ثابت بن قیس بن شماس کے نکاح میں زینب بنت عبداللہ بن ابی بن سلول تھی۔ اس کا حق مہر ایک باغ تھا، اس کو خاوند اچھا نہ لگا تو نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو اس نے باغ تجھے دیا ہے کیا تو واپس کرتی ہے ؟ کہنے لگی : باغ اور کچھ زیادہ بھی دوں گی تو نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : صرف باغ واپس کرو زیادہ نہیں تو کہتی ہے : ہاں۔ اس سے خاوند باغ لے لیا اور طلاق دلوا دی۔ جب ثابت بن قیس بن شماس کو نبی (صلی اللہ علیہ وآلہ وسلم) کے فیصلے کا علم ہوا تو اسے قبول کرلیا۔
Abu Zubair farmate hain ki Sabit bin Qais bin Shamas ke nikah mein Zainab bint Abdullah bin Abi bin Salul thi. Is ka haq mehr ek bagh tha, is ko khawanad achha na laga to Nabi ((صلى الله عليه وآله وسلم)) ne farmaya : jo is ne bagh tujhe diya hai kya tu wapas karti hai ? kahne lagi : bagh aur kuchh zyada bhi dungi to Nabi ((صلى الله عليه وآله وسلم)) ne farmaya : sirf bagh wapas karo zyada nahin to kahti hai : haan. Is se khawanad bagh le liya aur talaq dilwa di. Jab Sabit bin Qais bin Shamas ko Nabi ((صلى الله عليه وآله وسلم)) ke faisle ka ilm hua to ise qubool kar liya.
Abu Saeed narrates that my sister intended to take Khula (divorce initiated by wife) from her husband, so she went to the Prophet (peace and blessings of Allah be upon him) along with her husband. She mentioned her case before the Prophet (peace and blessings of Allah be upon him). He (peace and blessings of Allah be upon him) said: “Will you return his garden (that he gave you in Mahr) so that he divorces you?” She said: “Yes, and even more than that.” The Prophet (peace and blessings of Allah be upon him) asked the second time: “Will you return his garden so that he divorces you?” The woman said: “Yes, and even more than that.” The Prophet (peace and blessings of Allah be upon him) asked the third time, so the woman said: “Yes, and even more than that.” So she gave the garden and some extra to her husband.

(١٤٨٥٠) حضرت ابو سعید فرماتے ہیں کہ میری بہن نے اپنے خاوند سے خلع کا ارادہ کیا تو اپنے خاوند کے ساتھ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی، نبی (صلی اللہ علیہ وآلہ وسلم) کے سامنے تذکرہ کیا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کیا تو اس کا باغ واپس کرتی ہے کہ وہ تجھے طلاق دے دے۔ اس نے کہا : ہاں زیادہ بھی دوں گی۔ آپ نے دوسری مرتبہ پھر فرمایا : کیا تو اس کا باغ واپس کرتی ہے کہ وہ تجھے طلاق دے دے۔ اس عورت نے کہا : زیادہ بھی دوں گی۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے تیسری مرتبہ فرمایا تو اس عورت نے کہا : ہاں مزید بھی دوں گی۔ اس نے باغ اور کچھ زیادہ خاوند کو دے دیا۔
(14850) Hazrat Abu Saeed farmate hain ke meri behan ne apne khaavand se khula ka irada kiya to apne khaavand ke sath Nabi ((صلى الله عليه وآله وسلم)) ke paas aayi, Nabi ((صلى الله عليه وآله وسلم)) ke samne tazkara kiya to aap ((صلى الله عليه وآله وسلم)) ne farmaya: kya tu uska bagh wapas karti hai ke woh tujhe talaq de de? Usne kaha: haan zyada bhi dungi. Aap ne dusri martaba phir farmaya: kya tu uska bagh wapas karti hai ke woh tujhe talaq de de. Iss aurat ne kaha: zyada bhi dungi. Aap ((صلى الله عليه وآله وسلم)) ne teesri martaba farmaya to iss aurat ne kaha: haan mazeed bhi dungi. Usne bagh aur kuchh zyada khaavand ko de diya.
Abdullah bin Rabah narrated that Abdullah bin Umar said: "The one seeking Khula can do so, even for something as insignificant as a shoelace."

(١٤٨٥١) حضرت عبداللہ بن رباح فرماتے ہیں کہ حضرت عبداللہ بن عمر (رض) فرماتے ہیں کہ خلع کرنے والی تو بالوں کو باندھنے والے بند سے کم پر خلع کرسکتی ہے۔
(14851) Hazrat Abdullah bin Rabah farmate hain ki Hazrat Abdullah bin Umar (Raz) farmate hain ki khula karne wali to balon ko bandhne wale band se kam par khula kar sakti hai.
١٤٨٥١ - أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ، أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، نا أَحْمَدُ بْنُ الْعَبَّاسِ الْبَغَوِيُّ، نا أَحْمَدُ بْنُ مَنْصُورٍ، نا حَبَّانُ بْنُ هِلَالٍ، نا هَمَّامٌ، عَنْ مَطَرٍ، عَنْ ثَابِتٍ، عَنْ عَبْدِ اللهِ بْنِ رَبَاحٍ، أَنَّ عُمَرَ رَضِيَ اللهُ عَنْهُ قَالَ فِي الْمُخْتَلِعَةِ" تَخْتَلِعُ بِمَا دُونَ عِقَاصِ رَأْسِهَا "
Sunan al-Kubra Bayhaqi 14852
Ayyub Sakhtiyani reported that the slave of Samurah narrated to me that a woman, during the caliphate of Umar (may Allah be pleased with him), disobeyed her husband. So, the husband commanded her to stay in a house full of dung. She stayed there for three days and when he let her out, the husband asked: “How are you?” She replied: “I found peace in these days.” Umar (may Allah be pleased with him) said: “Then get Khula (divorce) from him, even if it be in exchange for a hair.”

(١٤٨٥٢) ایوب سختیانی فرماتے ہیں کہ سمرہ کے غلام نے مجھے بیان کیا کہ ایک عورت نے حضرت عمر (رض) کی خلافت میں اپنے خاوند کی نافرمانی کی تو خاوند نے بیوی کو بہت زیادہ گوبر والے گھر میں رہنے کا حکم دیا، وہ وہاں تین دن ٹھہری تو اس کو نکالا تو خاوند نے پوچھا : کیا حال ہے ؟ تو کہنے لگی : ان ایام میں مجھے سکون ملا ہے۔ حضرت عمر (رض) نے فرمایا : تو اس سے خلع کرلے، اگرچہ ایک بالی کے عوض ہی کیوں نہ ہو۔
Ayoub Sakhtiani farmate hain ke Samra ke ghulam ne mujhe bayan kiya ke ek aurat ne Hazrat Umar (RA) ki khilafat mein apne khaawand ki nafarmani ki to khaawand ne biwi ko bahut zyada gobar wale ghar mein rehne ka hukum diya, woh wahan teen din thahri to us ko nikala to khaawand ne poocha : kya haal hai ? To kehne lagi : in aiyam mein mujhe sakoon mila hai. Hazrat Umar (RA) ne farmaya : to us se khula karle, agarche ek baali ke awaz hi kyon na ho.
Abdullah bin Shahab Kholani narrates that a man divorced his wife in exchange for one thousand dirhams. When the matter was brought to Umar ibn al-Khattab (may Allah be pleased with him), he said, "Your husband has made a sale of the divorce." So, Umar (may Allah be pleased with him) considered it permissible.

(١٤٨٥٣) حضرت عبداللہ بن شہاب خولانی فرماتے ہیں کہ ایک عورت کو خاوند نے ایک ہزار درہم کے عوض طلاق دے دی۔ معاملہ حضرت عمر (رض) کے پاس آیا تو فرمانے لگے : تیرے خاوند نے طلاق کی بیع کرلی تو حضرت عمر (رض) نے اس کو جائز قرار دیا۔
14853 Hazrat Abdullah bin Shahab Kholani farmate hain keh aik aurat ko khaavand ne ek hazaar dirham ke awaz talaq de di. Mamla Hazrat Umar (RA) ke paas aaya to farmane lage: Tere khaavand ne talaq ki be krli to Hazrat Umar (RA) ne us ko jaiz qarar diya.
Umar bin Khattab (may Allah be pleased with him) said: When women seek divorce (khula) from their husbands, do not disrespect them.

(١٤٨٥٤) حضرت عمر بن خطاب (رض) فرماتے ہیں : جب عورتیں اپنے خاوندوں سے خلع کریں تو ان کی ناقدری نہ کرو۔
(14854) Hazrat Umar bin Khattab (RA) farmate hain : jab aurten apne khaawandon se khula karen to un ki naqadri na karo.
١٤٨٥٤ - أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، أنا أَبُو بَكْرٍ الْقَطَّانُ، نا إِبْرَاهِيمُ بْنُ الْحَارِثِ، نا يَحْيَى بْنُ أَبِي بُكَيْرٍ، نا أَبُو هِلَالٍ،نا عَبْدُ اللهِ بْنُ بُرَيْدَةَ قَالَ:قَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ" إِذَا أَرَادَ النِّسَاءُ الْخُلْعَ فَلَا تُكَفِّرُوهُنَّ "
Sunan al-Kubra Bayhaqi 14855
Nafi' narrates from a female servant that Safiyyah bint Abi Ubaid was the wife of Abdullah ibn Umar (may Allah be pleased with him). She sought Khula (divorce initiated by wife) from her husband in exchange for all her belongings, and Abdullah ibn Umar (may Allah be pleased with him) did not refuse her request.

(١٤٨٥٥) نافع ایک لونڈی سے نقل فرماتے ہیں کہ صفیہ بنت ابی عبید حضرت عبداللہ بن عمر (رض) کی بیوی تھی۔ اس نے اپنے خاوند سے ہر چیز کے بدلے خلع کیا تو حضرت عبداللہ بن عمر (رض) نے اس کا انکار نہیں کیا۔

١٤٨٥٥ - أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَسَنِ، نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ، أنا الشَّافِعِيُّ، أنا مَالِكٌ، ح، وَأنا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ، أنا أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي، نا مُحَمَّدُ بْنُ إِبْرَاهِيمَ، نا مَالِكٌ، عَنْ نَافِعٍ، عَنْ مَوْلَاةٍ لِصَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ، امْرَأَةِ عَبْدِ اللهِ بْنِ عُمَرَ" أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا بِكُلِّ شَيْءٍ لَهَا فَلَمْ يُنْكِرْ ذَلِكَ عَبْدُ اللهِ بْنُ عُمَرَ رَضِيَ اللهُ عَنْهُمَا "

Rabia bint Muadh bin 'Afra said: I married my cousin. He made things difficult for me and I made things difficult for him. He harmed me and I harmed him. He wronged me and so did I. He wronged me many times and so did I. A statement was issued on my behalf that I would give up all my wealth as compensation. He said: I accept. Uthman said: Take it. She said: I gave him all my belongings except for my clothes and bedding. He said: These are mine too. I refused. Then they took me to Uthman. When we approached him, he said: O Commander of the Faithful! I made it a condition that I get her possessions. Uthman said: Take all your belongings, even your hair tie. She said: I went and returned everything to him, and I closed the door between us.

(١٤٨٥٦) ربیع بنت معوذ بن عفراء کہتی ہیں کہ میں نے اپنے چچا زاد سے شادی کی، اس نے مجھے مشقت میں ڈالا اور میں نے اس کو مشقت میں ڈالا، اس نے مجھے تکلیف میں ڈالا اور میں نے اس کو تکلیف میں ڈالا، اس نے مجھے ظالم ٹھہرایا تو میں نے بھی، اس نے میرے اوپر کثرت سے ظلم کیا تو میں نے بھی کیا اور میری جانب سے ایک کلمہ کہہ دیا گیا کہ میں اپنا تمام مال فدیہ میں دیتی ہوں۔ اس نے کہہ دیا : میں نے قبول کیا۔ حضرت عثمان فرمانے لگے : لے لو۔ کہتی ہیں : میں نے اپنا تمام سامان اس کو دے دیا سوائے اپنے کپڑوں اور بستر کے۔ اس نے کہہ دیا : یہ بھی میرے پاس۔ میں راضی نہیں ہوں۔ پھر وہ مجھے لے کر حضرت عثمان (رض) کے پاس لائے۔ جب ہم ان کے قریب ہوئے تو کہنے لگا : اے امیرالمومنین ! میں نے ملکیت کی شرط رکھی ہے تو حضرت عثمان (رض) فرمانے لگے : اپنا تمام سامان لو حتیٰ کہ بال باندھنے کا بند بھی لے لو۔ کہتی ہیں : میں نے جا کر ہر چیز اس کو لوٹا دی اور میں نے اپنے اور اس کی درمیان دروازہ بند کرلیا۔
14856 Rabia bint Muaz bin Afra kahti hain ke maine apne chacha zad se shadi ki, usne mujhe mushqit mein dala aur maine usko mushqit mein dala, usne mujhe takleef mein dala aur maine usko takleef mein dala, usne mujhe zalim thahraya to maine bhi, usne mere upar kasrat se zulm kiya to maine bhi kiya aur meri jaanib se ek kalma kah diya gaya ke main apna tamam maal fidya mein deti hun. Usne kah diya : maine kabul kiya. Hazrat Usman farmane lage : le lo. Kahti hain : maine apna tamam saman usko de diya siwaye apne kapdon aur bistar ke. Usne kah diya : yeh bhi mere paas. Main raazi nahin hun. Phir woh mujhe le kar Hazrat Usman (RA) ke paas laye. Jab hum unke qareeb huye to kahne laga : aye ameerul momineen ! maine milkayat ki shart rakhi hai to Hazrat Usman (RA) farmane lage : apna tamam saman lo hatta ke baal bandhne ka band bhi le lo. Kahti hain : maine ja kar har cheez usko luta di aur maine apne aur uski darmiyan darwaza band karliya.
